This easement is not in substitution for and is without prejudice to such statutory rights and authorities as the grantee may have from time to time in respect of the servient land.

The ownership of a line, lines and works installed in, over or under the easement land from time to time by the grantee shall at all times remain vested in the grantee and no person shall have any interest in such line, lines or works by reason only of having an interest or an estate in the land.
Disputes
- Any dispute arising out of or in connection with the rights created by this easement shall be resolved by arbitration under the Arbitration Act 1996 and its amendments or any enactment passed in substitution. The arbitrator shall decide the dispute according to the substantive law of New Zealand.

Notice of Intention to Take Land for Road—East Coast Road, Redvale, Parish of Okura
Notice is hereby given that the Rodney District Council (“the council”), under the provisions of section 23 of the Public Works Act 1981, proposes to take the land described in the Schedule hereto (“the land”).
The adjacent land has been formally designated as road (the PENLINK roading project) in accordance with the designation decision dated 18 December 1998, subject to the Consent Orders of the Environment Court dated 27 February 2001.
The construction and subsequent operation of the PENLINK roading project is considered to be for the greater public good.
On the taking of the land for the PENLINK roading project and the construction of the road (a limited access road), it will not be practicable to provide safe and convenient access to the land referred to in the Schedule to this notice.
The owners of the land and those persons with a registered interest in it have been served with notice of the Crown’s intention to take the land and advised of their right to object.
Any other person having the right to object may send a written objection to the Registrar, Environment Court, Tribunals Division, Department for Courts, P.O. Box 5027, Wellington, within 20 working days after the date of publication of this notice.
If any objection is made in accordance with this notice, a public hearing will be held.
The objector will have a right to appear and be heard personally unless the objector otherwise requires.
Each objector will be informed of the time and place of the hearing.

Copies of the plans may be viewed at the offices of the Rodney District Council, 50 Centreway Road, Orewa.

Reserves Act 1977
Authorisation of the Exchange of Part of a Reserve
Under the Reserves Act 1977, the Community Relations Manager for the East Coast Hawke’s Bay Conservancy of the Department of Conservation authorises the exchange of that part of the reserve described in the First Schedule for the land described in the Second Schedule.

Hawke’s Bay Land District—Hastings District Council
8.9084 hectares, being Section 18, S.O. 911. Being part of the Boundary Stream Scenic Reserve.
Second Schedule
Hawke’s Bay Land District—Hastings District Council
45.7126 hectares, being Section 1, S.O. 8941. To be included in the Boundary Stream Scenic Reserve.
