be road which, pursuant to section 88 (2) of the Transit
New Zealand Act 1989, becomes road, limited access road
and State highway on the date of publication of this notice in
the New Zealand Gazette.

to that effect having been entered into, the land described in
the First Schedule to this notice is hereby acquired for water
supply purposes and vested in the Western Bay of Plenty
District Council on the date of publication of this notice in
the New Zealand Gazette.

(b) Pursuant to sections 20 and 28, declares that, an
agreement to that effect having been entered into, a right of
way, and right to convey water and electricity, as described
in the Third Schedule to this notice, is hereby acquired for
water supply purposes over the land described in the Second
Schedule to this notice and vested in the Western Bay of
Plenty District Council on the date of publication of this
notice in the New Zealand Gazette.

Schedule of the Land Transfer Regulations 2002) shall not
have the rights and powers set out in clause 3 of the Fourth
Schedule of the Land Transfer Regulations 2002, nor shall
the grantor grant the rights set out in clause 3 to any other
persons.
