Education Act 1989
The Education (Domestic Students) Notice 2003
Pursuant to section 2 (1) (e) of the definition of the term
“domestic student” and section 4A (1) of the Education Act
1989, the Minister of Education, by and through the Senior
Manager, National Operations, Ministry of Education,
acting under delegated authority, gives the following notice.
Notice
- Title and commencement—(1) This notice may be
cited as the Education (Domestic Students) Notice 2003.
(2) This notice shall come into force on the day after the
date of its publication in the New Zealand Gazette.
- Persons to be treated as if they are not foreign
students—For the purposes of Parts I to III, and section
79 (2) of the Education Act 1989, foreign students of the
following kind, class or description are persons who are
required to be treated as if they are not foreign students and
who are entitled to enrol at State schools:
● A foreign student who has entered New Zealand for the
purposes of adoption:
(a) and whose adoption application before the
New Zealand Family Court (where the Final Order
will entitle those children to education as domestic
students) is supported by the Department of Child,
Youth and Family Services and who has a letter
from the Department of Child, Youth and Family
Services confirming this support; or
(b) who is the subject of an Interim Order of Adoption
granted by the New Zealand Family Court under
section 5 of the Adoption Act 1955 (where the Final
Order will entitle those children to education as
domestic students).

Alternative Constitution for John Paul II High School (304) and St Patrick’s Primary School (3538), Greymouth
Pursuant to section 105A of the Education Act 1989,
I hereby give the following notice:
Constitution
I hereby approve the following alternative constitution for
the combined board of John Paul II High School and
St Patrick’s Primary School, Greymouth, under section
105A of the Education Act 1989 (“the Act”):
● six parent representatives (three from each school);
● the principal from each school;
● two staff representatives (one from each school);
● one student representative (from John Paul II High
School); and
● four proprietor’s representatives.
Parent Representatives
-
The parent representatives will be elected in accordance
with section 96 (3) of the Act. -
Each candidate shall be nominated in respect of each
school the combined board will administer. -
The three highest polling candidates nominated in
respect of each school shall become a trustee, regardless
of the votes cast for the other candidates.
Casual Vacancies
-
Casual vacancies for all trustees will arise in accordance
with section 104 of the Act, and be filled in
accordance with section 105 of the Act. -
Elections required under this notice or under the Act will
be carried out under the Education (School Trustee
Elections) Regulations 2000. For the first election, a
returning officer will be appointed by a joint decision of
the current boards and will carry out the duties in
accordance with the Regulations.
General Applications
All other sections or any Schedules of the Act relating to
school boards of trustees will apply to the combined board.

Establishment of a Combined Board of Trustees
Pursuant to section 110 of the Education Act 1989, I hereby
establish a combined board of trustees to administer the
following schools:
John Paul II High School (304)
St Patrick’s Primary School (3538)
with effect from 25 March 2003.
This notice shall come into force on 25 March 2003.

Constitution for the Combined Board of Trustees of St Joseph’s School, Invercargill (4017), St Patrick’s School, Nightcaps (4019) and St Teresa’s School, Bluff (4021)
Pursuant to section 105A of the Education Act 1989,
I hereby give the following notice:
Membership of the Board
The combined board of St Joseph’s School, Invercargill
(4017), St Patrick’s School, Nightcaps (4019) and St
Teresa’s School, Bluff (4021) (“the three schools”) will be
made up of the following people:
● nine parent representatives (three representing each
school);
● three principals (one from each school);
● one staff member (elected by the staff of the three
schools and representing the interests of the teachers at
the three schools); and
● four proprietors’ representatives (appointed by the
Roman Catholic Bishop of Dunedin).
Parent Representatives
- A single election for the schools’ parent representatives
shall be held, with the representatives being nominated
and elected in accordance with section 96 (3) of the
Education Act 1989 (“the Act”) and the Education
(School Trustees Election) Regulations 2000 (“Election
Regulations”) with any necessary modifications.
