Acquiring an Easement in Gross to Drain Water—State Highway No. 16, Port Albert Road, Rodney District

Pursuant to sections 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Stephen Robert Gilbert, Land Information New Zealand, declares that, pursuant to an agreement having been entered into, an easement in gross is acquired over the land described in the First Schedule (“the easement land”) for the purpose of draining water and shall vest in the Crown and its successors as grantee in perpetuity on the date of publication of this notice in the New Zealand Gazette, upon the terms set out in the Third Schedule.

Terms and Conditions

1. The grantee shall have the right:
   (i) To drain water forever by means of underground pipes over the easement land.
   (ii) To lay, inspect, maintain, repair or re-lay in and under the soil along the easement land pipes and any associated fixtures and fittings as reasonably required for the drainage of water.
   (iii) To enter upon the servient land for the purpose of inspecting, maintaining, re-laying, repairing, replacing or altering the said pipes and fixtures and fittings, as the case may be, and opening up the soil of the easement land making any cuttings, trenches and fillings, and to reopen the same, and generally to do and perform such acts or things upon the easement land as may be necessary to enable the grantee to receive the full use and enjoyment of the rights and privileges granted to the grantee.

2. The grantee will make good any damage to the servient land including without limitation reinstating all fencing, driveways, and areas of garden and lawns to a similar standard to that which exists immediately prior to the exercise of the grantee’s rights pursuant to this easement.

Road Realignment—State Highway No. 1, Vinegar Hill, Rangitikei District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Stephen Robert Gilbert, Land Information New Zealand:

(a) Pursuant to section 114, declares the land described in the First Schedule to this notice to be road which, pursuant to section 88 (2) of the Transit New Zealand Act 1989, becomes road, limited access road and State highway and shall vest in the Crown on the date of publication of this notice in the New Zealand Gazette.

(b) Pursuant to sections 116 and 117, declares the portions of road described in the Second Schedule to this notice to be stopped and, pursuant to section 120 (3), further declares:
(i) Sections 29 and 32 shall be amalgamated with the land in certificate of title 36B/967, subject to notices A. 018963, A. 041969 and B. 077589.2.
(ii) Section 30 shall be amalgamated with the land in certificate of title 218/143, subject to notice A. 018963.
(iii) Section 35 shall be amalgamated with the land in certificate of title 521/154, subject to notice A. 018963.
(iv) Sections 36 and 37 shall be amalgamated with the land in certificate of title E2/385.
(v) Section 39 shall be amalgamated with the land in certificate of title 32A/447, subject to notice A. 018963.
(vi) Section 43 shall be amalgamated with the land in certificate of title 34C/103, subject to mortgage 5075518.1 and notice A. 018963.
(vii) Section 64 shall be amalgamated with the land in certificate of title 9B/336, subject to notice A. 018963.

(c) Pursuant to section 119, declares the severance described in the Third Schedule to this notice to be taken and further declares:
(i) Sections 47, 63, 97, 111 and 112 shall be amalgamated with the land in certificate of title 9B/336, subject to notice A. 018963.
(ii) Sections 48, 49 and 62 shall vest in the Crown on the date of publication of this notice in the New Zealand Gazette.
(iii) Sections 54 and 56 shall be amalgamated with the land in certificate of title 218/143, subject to notice A. 018963.
