1952, by James Paul Phillips and Janine Gaye Legge, the registered proprietors of the land described below, for the noting of the extinguishment of a right of way recorded against that title, details of which are also set out below.

Land Description

An estate in fee simple in 1.6590 hectares, more or less, being part Lots 34, 35 and 36, Deeds Plan 90, being also all the land contained in certificate of title WNB1/562 (Wellington Land Registration District).

Description of Right of Way to be Extinguished

Right of way created over part of above land by conveyance 125172 (Deeds Record Book 231/125).

The above right of way has not been formed or used and the rights conferred by that conveyance appear to have been no more than an undertaking by the owner of that land to create a right of way should the owner be called upon to do so. There is no evidence that this undertaking was put into effect.

Therefore, it is my intention to record on the 22nd day of August 2002, that the said right has been extinguished and determined unless before that date good reason is given to me that I should not.
