Telecommunications Act 2001

Determination of Terms of Supply

On 16 May 2002, TelstraClear Limited, on behalf of itself and Clear Communications Limited, applied under section 20 of the Telecommunications Act 2001 (“the Act”) for a determination of terms on which interconnection with Telecom’s fixed public switched telephone network (PSTN), and interconnection with TelstraClear’s fixed PSTN, must be supplied.

Pursuant to section 25 (1) (c) of the Act, the Commerce Commission gives public notice that it has decided, under section 25 of the Act, to investigate the TelstraClear application for determination, so far as it concerns interconnection with Telecom’s fixed PSTN and TelstraClear’s fixed PSTN.

Determinations of Terms of Supply

On 17 May 2002 and 22 May 2002 respectively, Telecom Corporation of New Zealand and Telecom New Zealand Limited applied for two determinations under section 20 of the Telecommunications Act 2001 (“the Act”) of terms on which interconnection with Telecom’s fixed public switched telephone network (PSTN) and interconnection with TelstraClear’s fixed PSTN must be supplied.

Pursuant to section 25 (1) (c) of the Act, the Commerce Commission gives public notice that it has decided, under section 25 of the Act, not to investigate Telecom’s applications.

Instead, it will address all matters raised by Telecom in the context of the 16 May 2002 application by TelstraClear Limited for a determination of terms on which interconnection with Telecom’s fixed PSTN and interconnection with TelstraClear’s fixed PSTN must be supplied.
