Notice of Entry into Possession of Mortgaged Property

In the matter of section 104DD of the Property Law Act 1952, and in the matter of memorandum of mortgage No. D. 411772.2 (North Auckland Registry) from Parkbrook Holdings Limited (mortgagor) to Negotiable Investments Limited (previous mortgagee) and subsequently transferred to Myrle Dawn Alexander (mortgagee):

Pursuant to Section 104DD of the Property Law Act 1952

Pursuant to section 104DD of the Property Law Act 1952, notice is given as follows:

  1. The mortgagee is mortgagee under mortgage No. D. 411772.2, the mortgage having been transferred to her on 2 May 2002.

  2. On 15 May 2002, the mortgagee, under the mortgage No. D. 411772.2, entered into Unit 6B of the mortgaged property, more particularly described below.

  3. The address of the mortgagee is at the offices of Martelli McKegg Wells & Cormack, Barristers and Solicitors, Fourteenth Floor, National Bank Centre, Anderson Tower, 209 Queen Street (P.O. Box 5745), Auckland 1. Attention: J. K. Kenyon or A. W. Johnson.

  4. The description of the mortgaged property is:

4.1 All the land comprised and described in Principal Unit 6A and Accessory Unit 53, 54 and 200 on Deposited Plan 201161 and more particularly described in certificate of title 129D/582 (North Auckland Registry);

4.2 All that land comprised and described in Principal Unit 6B and Accessory Units 40-41, 46, 50, 147, 149 and 169 on Deposited Plan 201161 and more particularly described in certificate of title 133C/898 (North Auckland Registry);

4.3 All that land comprised and described in Principal Unit 5D and Accessory Units 35, 36 and 175 on Deposited Plan 201161 and more particularly described in certificate of title 129D/573 (North Auckland Registry);

All being situated at 118 Gladstone Road, Parnell, Auckland.

Take notice that on the 16th day of May 2002, Tower Trust Limited, by virtue of memorandum of mortgage No. B. 831206.8 (Wellington Registry), entered into possession of the properties at Apartments 1E, 2F and 2G, 4 Queen Street Palmerston North.

Notice of Proposed Release of Deposit

Pursuant to the Insurance Companies’ Deposits Act 1953

Premier Insurance Limited (hereinafter called “the company”) has given notice to the Public Trust that it has ceased to carry on the business of insurance in New Zealand and that it proposes to withdraw, pursuant to section 19 of the Act, the deposit which has been made by it with the Public Trust.

The Public Trust therefore gives notice, pursuant to section 19 (3) of the Act, that, being satisfied that all liabilities of the company in New Zealand in respect of such insurance business have been fully liquidated or provided for, it proposes to release to the company on or after the 20th day of June 2002, the amount deposited with the Public Trust by the company.

Any objections to the release of the amount deposited should be lodged with the Public Trust at the Public Trust Office, 117-125 Lambton Quay, Wellington 1, on or before the 12th day of June 2002.
