16. Transitional arrangements

(1) Subclause (2) applies to every person who, under the former clause 15.5.2 of the special needs grants welfare programme under section 124 (1) (d) of the Act:

(a) was receiving special needs grants for living expenses immediately prior to the commencement of this programme; or

(b) had been paid special needs grants for living expenses in advance for a period or periods ending on or after the commencement of this programme.

(2) A person referred to in subclause (1) is entitled to receive living expenses grants under this programme if:

(a) the person continues to be eligible for such grants; and

(b) none of the events referred to in clause 12 has occurred.

(3) No living expense grant may be made to a person referred to in subclause (1) for the same period that the person has received payment of a grant for living expenses under the former clause 15.5.2 of special needs grants welfare programme.


Explanatory Note:

This note is not part of the Programme, but is intended to explain its general effect.

This programme allows travel, set-up and living expense grants to be made to people who need to relocate to an approved overseas country to avoid ongoing threats of serious injury arising from domestic violence or as a witness. It replaces the emergency relocation provisions in the Special Needs Grants Programme.

Special Needs Grants Amendment 2002

Pursuant to section 124 (1) (d) of the Social Security Act 1964, the Minister of Social Services and Employment makes the following Amendment to the Special Needs Grants Programme (as established and approved on 18 December 1998).

Amendment

  1. Title—(1) This Amendment is the Special Needs Grants Amendment 2002.

(2) In this Amendment, the Special Needs Grants Programme is called “the programme”.

  1. Commencement—This Amendment comes into effect on the day after the date on which the Minister approves it.

  2. Emergency relocation costs—Clause 15.5.10 of the programme is amended by inserting after the word “under”, the words “the former”.

  3. Revocations—The following are revoked:

(a) Clauses 15.5.1 to 15.5.9 and 15.5.11 to 15.5.13 of the programme;

(b) So much of the Special Needs Grants Programme Amendment (No. 3) as relates to the clauses of the programme referred to in paragraph (a);

(c) The Special Needs Grants Amendment 2001.


Explanatory Note:

This note is not part of the Amendment but is intended to explain its general effect.

This Amendment revokes the provisions of the programme relating to Emergency Relocation Costs other than the clause relating to recoverability.

Notice of Disclaimer Under Section 325 of the Companies Act 1993

In the matter of the Land Transfer Act 1952, and in the matter of section 325 of the Companies Act 1993, and in the matter of Dantorose Holdings Limited:

Take notice that I, Alan Esmond Bollard, Secretary to the Treasury, pursuant to section 325 of the Companies Act 1993, hereby disclaim for and on behalf of Her Majesty the Queen, all right, title and interest of Her Majesty the Queen in lease D. 356973.2, for a term of 21 years from 7 February 1998 between The Melanesian Mission Trust Board (“as lessor”) and Dantorose Holdings Limited (“as lessee”) (by virtue of transfer of lease No. D. 522915.2), in respect of an estate in fee simple in all that parcel of land containing eight hundred and eighty-two square metres (882m²), more or less, being Lot 103 on Deposited Plan 43408 and being part Allotment 29, District of Tamaki, and being all the land comprised and described in certificate of title No. 17A/323, North Auckland Land Registry, being a lease formerly held by Dantorose Holdings Limited, a company removed from the Companies Register on 9 May 2001.

And I certify that the vesting of the said lease did not come to my notice until 15 October 2001.
