Nurses Act 1977

Order of the Nursing Council in Disciplinary Session in Respect of a Registered Psychopaedic Nurse

After due inquiry and in exercise of its powers under sections 42 (1) (b), 42 (2) (a), 42 (3) and 48A of the Nurses Act 1977, the Nursing Council of New Zealand (“the council”), in a decision dated 15 August 2002, ordered that Garth Edward Simpson’s name be removed from the Register of Psychopaedic Nurses.

It declined to fix a time after which he could apply to have his name restored to the Register.

The council also ordered that Garth Edward Simpson pay $2,420.00 (being 25%) towards the actual costs and expenses of and incidental to the investigation and prosecution by the preliminary proceedings committee and inquiry by the council and ordered that a notice stating the effect of these orders be published in the New Zealand Gazette, Kai Tiaki: Nursing New Zealand and the nursing council’s newsletter with suppression of the names of all other parties and identifying features of the case.

After due inquiry and in exercise of its powers under sections 42 (1) (b), 42 (2) (d), 42 (3) and 48A of the Nurses Act 1977, the Nursing Council of New Zealand (“the council”), in a decision dated 26 September 2002, ordered that the psychiatric nurse be censured.

The council also ordered that the nurse pay $9,684.00 (being 30%) towards the actual costs and expenses of and incidental to the investigation and prosecution by the preliminary proceedings committee and inquiry by the council and that a notice stating the effect of the orders be published in the New Zealand Gazette, Kai Tiaki: Nursing New Zealand and the nursing council’s newsletter with suppression of the names of all parties and identifying features of the case.
