Dental Act 1988
Revised Conditions for the Practice of Dentistry
In terms of section 7 of the Dental Act 1988, I hereby advise
of the following revised conditions for the carrying-on of
the practice of dentistry commencing from the date of this
notification:
-
Persons employed as dental therapists:
(a) will be holders of a New Zealand Dental Therapy
qualification issued by the Department of Health¹
or a New Zealand University or Polytechnic; or
(b) will produce evidence of having successfully
completed a course of training that is accepted
by the Director-General of Health as being
equivalent to the course of training required
for qualification under (a) above. -
The functions undertaken by persons employed in
terms of section 7 of the Dental Act 1988 will be
commensurate with their formal training. Such training
will imply successful completion of a course or courses
recognised for the purpose by the Director-General of
Health. -
Persons engaged in the practice of dentistry in terms
of 1. and 2. above, under section 7 of the Dental Act
1988, will operate under the direction and supervision
of a principal dental officer or other registered dentist
acting on the authority of a principal dental officer.

Notes: Without limiting the terms of description:
“Principal Dental Officer” means a registered dentist
appointed by a District Health Board to fulfil the
requirements of section 7 of the Dental Act 1988.
“Direction and Supervision” includes the promulgation of
clinical guidelines, ensuring ready access to clinical
guidance, ensuring the safe management of medically
compromised children and ensuring clinical audit.
¹ The Ministry of Health succeeded the Department of Health on 1 July
1993. Persons issued a New Zealand Dental Therapy qualification prior to
1 July 1993 may be employed as dental therapists. The Ministry of Health
does not issue New Zealand Dental Therapy qualifications. All New Zealand
Dental Therapy qualifications are now issued by a New Zealand university
or polytechnic.

Health and Disability Services (Safety) Act 2001
Designation of Auditing Agency
Pursuant to section 32 of the Health and Disability Services
(Safety) Act 2001 (“the Act”), the Director-General of
Health designates SGS International Certifications Pty
Ltd (“the auditing agency”) to audit the provision or likely
future provision of the following kinds of health care
services:
Hospital Care (as defined in section 4 (1) of the Act)
Rest Home Care (as defined in section 6 (2) of the Act)
Residential Disability Care (as defined in section 4 (1) of
the Act)
This designation is subject to the following conditions:

The auditing agency must ensure that where it audits the
provision of health care services for people with physical
or sensory disabilities, or intellectual disabilities, or
psychiatric disabilities or mental illnesses, the auditing
agency observes the following:
● For audits involving services for people with physical
or sensory disabilities, a person with a pronounced
physical or sensory disability respectively must fully
participate in all aspects of the audit.
● For audits involving services for people with
intellectual disabilities, a person with an intellectual
disability (accompanied by a support person where
necessary), or a close family or whanau member of a
person with an intellectual disability, must participate
in all aspects of the audit.
● For people with psychiatric disabilities or mental
illnesses, a past or present consumer of mental health
services must fully participate in all aspects of the
audit. -
The auditing agency must inform the Ministry of Health
immediately by way of written notice if there is any
change to their accreditation status with JAS-ANZ.
Under section 38 of the Act, this designation will expire
three years after the date of this notification in the
New Zealand Gazette.
