Revocation of Dissolution of Charitable Trust Board

Section 26 (3) of the Charitable Trusts Act 1957

The Registrar of Incorporated Societies is satisfied that the dissolution of the following charitable trust ought to be revoked and has declared accordingly:

Assembly of God (Otorohanga) Trust Board 265727
(5 October 1993).

With this publication such trust is revived from the date of its dissolution (noted above) as if no dissolution had taken place.

J R McKenzie Trust Board

Notice of Approval of a Scheme

Pursuant to Part III of the Charitable Trusts Act 1957

Notice is hereby given that on the 1st day of October 2002, the High Court of New Zealand at Wellington made an order approving, on the application of the J R McKenzie Trust Board as trustee of the J R McKenzie Trust, a scheme under Part III of the Charitable Trusts Act 1957.

The scheme does not vary any of the charitable objects of the trust but modifies the composition of the board, and extends and modifies the powers and duties of the trustees and the administrative powers of the board.

In particular, the scheme provides for:

  1. The appointment of members of the board by the McKenzie family, the New Zealand Law Society,

    the New Zealand Medical Association, certain organs of the Rotary organisation and the board itself.

  2. The passing of resolutions by the board.

  3. The presence of observers at meetings of the board.

  4. The term of trustees’ appointment.

  5. Appointment of the board’s chairperson.

  6. The holding and application of the funds (both income and capital) of the trust.

  7. The power to make regulations for the more efficient administration of the board’s operations.

  8. Remuneration of trustees.

  9. The powers of the board to use funds of the trust for operational purposes.

  10. The preparation and audit of accounts.

  11. Delegation of the board’s powers.

  12. Use of the board’s common seal.

  13. Resolution of disputes.

  14. Resolution of conflicts of interest between trustees and the trust.

  15. The liability of trustees.

  16. Trustees’ rights of indemnity.

  17. The board’s powers of investment.

  18. The provision of receipts.

  19. The winding up of the trust.

The scheme and the order approving it may be inspected free of charge at the offices of the Registrar of the High Court at Wellington.
