(4) Despite subparagraph (1), in particular cases or classes
of case, Public Trust and the depositor may agree on a rate
of interest payable on a special deposit that is different from
the rate specified in Schedule 1 and the agreed rate then
applies.

4. Revocation of notice and transitional provisions—
   (1) The Public Trust Common Fund Interest Rates Notice
   10 October 2002 is revoked.
   (2) The rates of interest specified in Schedule 1 to this notice
   do not apply to any period that ends with 14 October 2002
   but otherwise operate as from 15 October 2002.
   (3) The rates of interest specified in Schedule 2 to this
   notice:
   (i) do not apply to investment deposits repayable at
   the end of a fixed term that commenced prior to
   15 October 2002; but
   (ii) do apply to investment deposits repayable at the
   end of a fixed term that commenced on or after
   15 October 2002.

Notice of Indemnity Given Pursuant to Section
59 (1) of the Public Finance Act 1989—AgriQuality
New Zealand Limited Against Third Party Claims

Pursuant to section 59 (2) of the Public Finance Act 1989,
the Minister of Finance makes the following statement:

"On 9 October 2002, I, the Honourable Dr Michael
Cullen, Minister of Finance, gave an indemnity in favour
of AgriQuality New Zealand Limited under an agreement
to be entered into between Her Majesty the Queen in
Right of New Zealand acting by and through the Minister
for Biosecurity and AgriQuality New Zealand Limited
for the provision of management and delivery of the
operational headquarter services, and all associated
operational components, for the Painted Apple Moth
incursion response. The indemnity will indemnify
AgriQuality New Zealand Limited against third party
claims in respect of any chemical effects, long term effects
on health or the environment, or other effects which may
result in the future from the use of the Btk spray to
eradicate the Painted Apple Moth.
