At Wellington this 16th day of September 2002

Present:
HER EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to section 37ZZZJ of the Local Government Act
1974, Her Excellency the Governor-General, acting on the
advice and with the consent of the Executive Council,
makes the following order.

Order

1. Title and commencement—(1) This order may be cited
   as the Local Government (Waipa District and Waikato
   District) Boundary Alteration Order 2002.

(2) This order comes into force on 1 October 2002.

2. Boundary alteration—The boundaries of Waipa
   District and Waikato District are altered by excluding the
   area described in the Schedule from Waipa District and
   including it in Waikato District.

3. Wards—The area described in the Schedule ceases to
   form part of the Pirongia Ward of Waipa District (as
   defined on S.O. Plan No. 58027 deposited with the Chief
   Surveyor of the South Auckland Land District), and forms
   part of the Newcastle Ward of Waikato District (as defined
   on S.O. Plan No. 57997 deposited with the Chief Surveyor
   of the South Auckland District).

Schedule

Area Excluded From Waipa District and Included in Waikato District

All that area comprising:

Firstly, that part of Allotment 89, Tuhikaramea Parish,
S.O. Plan 28678, South Auckland Land District, situated
in Waipa District; and

Secondly, all that part of Wallace Road situated between
the area firstly described in this Schedule and the middle
line of Wallace Road.

Land Set Apart for Use in Connection With a Road

—State Highway No. 1, Albany-Puhoi, Rodney District

Pursuant to section 52 (1) of the Public Works Act 1981,
and to a delegation from the Minister of Land Information,
Ronald Alistair Jolly, Land Information New Zealand,
declares the land described in the Schedule to this notice to
be set apart for use in connection with a road and shall
remain vested in the Crown on the date of publication of this
notice in the New Zealand Gazette.

Land Taken as Severance and Building Restriction Created

—State Highway No. 1, Albany-Puhoi, Rodney District

Pursuant to the Public Works Act 1981, and to a delegation
from the Minister for Land Information, R. J. Sutherland,
Land Information New Zealand:

(a) Declares the land described in the First Schedule to
this notice to be taken under section 119 (1) and shall vest in
the Crown on the date of publication hereof in the
New Zealand Gazette.

(b) Pursuant to section 236, declares the land described
in the Second Schedule to this notice (“the fill area”) to be
subject to the following restrictions:

(i) No person shall erect or permit to be erected any
building or structure or carry out any earthworks on
the fill area otherwise than in accordance with
the recommendations of a registered engineer
experienced in soil mechanics.

(ii) Any building or structure erected or any earthworks
carried out on the fill area shall be erected or carried
out at the sole risk of the owner and the owner shall
have no recourse to the Crown in respect of the fill
area.

(iii) The owner will not erect any building or structure or
carry out any earthworks on the fill area in a manner
that will adversely affect the structural integrity of
the motorway and will not object to any application
by the Crown seeking building or resource consents.
