Civil Aviation Act 1990

Notice of Granting of an Open Aviation Market Licence

Pursuant to the Civil Aviation Act 1990, and the State Sector Act 1988, I, John Gibson Bradbury, Deputy Secretary Air Services, in the Ministry of Transport, hereby give notice that I have exercised the power conferred by section 87U of the Civil Aviation Act 1990, and granted to Freedom Air Limited of Auckland, New Zealand, an open aviation market licence authorising the airline to operate international air services for the carriage of passengers, cargo and mail between points in New Zealand and points in Australia.

The licence was granted with effect from 11 September 2002.

Maritime Transport Act 1994

Notice of Declaration of Major Maritime Events

Pursuant to section 200A (1) of the Maritime Transport Act 1994 and on the application of the Auckland Regional Council, I declare the following to be events to which section 200B of the Maritime Transport Act 1994 applies for the periods specified:

  • The Louis Vuitton Cup 2002/2003 (1 October 2002 – 21 January 2003 inclusive);
  • The Defender’s Internal Racing Campaign (1 October 2002 – 14 February 2003 inclusive);
  • The Thirty First America’s Cup Match (15 February 2003 – 6 March 2003 inclusive).

Designated Area

The designated area to which this declaration applies comprises the following areas of Auckland Harbour:

America’s Cup Village area, being all those waters lying to the south of a line joining the northernmost ends of Wynyard Wharf and Princes Wharf.

Inner Harbour West area, being all those waters lying to the east of the Auckland Harbour Bridge and to the west of a line drawn between Point Resolution and the south-eastern end of Devonport Wharf.

Inner Harbour East area, being all those waters bounded to the west by a line drawn between Point Resolution and the south-eastern end of Devonport Wharf, to the south by number 8 and number 10 buoys, the northern tip of Fergusson Wharf, to the east by Bean Rocks Lighthouse and by number 6 and number 4 buoys and thence to Rangitoto Beacon, to the north by latitude 36° 46.7' S.

Race Track area, being all those waters bounded to the south by latitude 36° 46.7' S, to the west by the coastline of the North Shore, to the north by the coastline of the Whangaparaoa Peninsula extended to the southern tip of Tiritiri Matangi Island and thence to 36° 36' S 174° 59' E, to the east by a line drawn from position 36° 36' S 174° 59' E to the Ahaaha Rocks thence to the northern tip of Motuhoropapa Island thence to the northern tip of Rakino Island and thence by a line from the northern tip of Rakino Island to Billy Goat Point and along the shoreline of Motutapu and Rangitoto Islands, to join with latitude 36° 46.7' S.

Conditions and Requirements

The following conditions and requirements must be complied with in the designated area:

  1. America’s Cup Village area:
    (a) All vessels are restricted to a maximum speed of 5 knots;
    (b) No vessel may approach within 100 metres of vessels transferring fuels or chemicals at Wynyard Wharf; and
