no aspirations on the good faith or intent of Ngāti Tama. I simply draw the Minister’s attention to the indication to and expectation by the local community and interested parties as to broad representation on the committee of management so that he may have regard to this when nominations are received.

Likewise, although agreement has been reached as to exclusion of certain activities over part of the area from regulation, this agreement cannot be imposed as a condition of taiapure as there is no provision under the Act to impose conditions. Administratively however, the Ministry can recognise the agreement by refusing to approve any regulations that breach it, unless there is further consensus among the interested parties over the nature of such regulations. I draw attention to the importance of this agreement as a means whereby consensus among the parties was obtained.

Recommendation

For the reasons set out earlier, the Tribunal finds that the proposed taiapure is in accord with the intent of the legislation and that there is no apparent reason to decline the making of an order under section 174 (2).

The specific agreement reached between commercial fishing interests and the applicant and the representation and general understanding that sector interests will be included on the committee of management are recorded. It is therefore anticipated that the Minister and the Ministry will use their powers as far as possible to ensure adherence to both the agreement and understanding.

On this basis, the Tribunal recommends that a taiapure be established over the area specified in the Gazette Notice notifying the application.

2. Decision of the Minister of Fisheries

Acting, pursuant to section 181 (9) of the Fisheries Act 1996, as Minister of Fisheries, I have taken into account the report and recommendation of the Tribunal and having had regard to the provisions of section 176 (2) of the Act and after consultation with the Minister of Māori Affairs, I hereby publish my decision on the report and recommendation of the Tribunal concerning the Whakapuaka taiapure-local fishery proposal.

In regard to the recommendation in the Tribunal report that a taiapure-local fishery be established over the area specified in the Fisheries (Notification of Proposal to Establish Whakapuaka Taiapure-Local Fishery) Notice 1999 notifying the application, I have decided to accept the recommendation.

In regard to the specific agreement reached between the commercial fishing interest and the applicant, and the representation and general understanding that sector interest will be included on the committee area management, I have noted the Tribunal’s comments.
