Dumping and Countervailing Duties Act 1988

Termination of Dumping Investigation: Hollow Gold Jewellery From Italy

Notice is hereby given that, acting pursuant to section 11 of the Dumping and Countervailing Duties Act 1988 (hereinafter referred to as “the Act”), I have terminated a dumping investigation in respect of hollow 9-carat gold jewellery from Italy (“the subject goods”) as described in the Notice of Initiation of Dumping Investigation of 12 June 2001 (New Zealand Gazette, 21 June 2001, page 1511) imported or intended to be imported into New Zealand.

I have terminated the investigation because I am satisfied that under section 11 (1) (e), New Zealand producers who previously expressed support for the application for the investigation have withdrawn that support in writing to such an extent that, by reason of section 10 (3) of the Act, the investigation could not have been initiated.

Dated at Wellington this day of 22nd July 2001.

PAUL SWAIN, Minister of Commerce.

Notice of Review of Imposition of Anti-Dumping Duty: Canned Peaches From South Africa

I hereby give notice that, pursuant to section 14 (8) of the Dumping and Countervailing Duties Act 1988, and acting under delegated authority from the Chief Executive of the Ministry of Economic Development, I have initiated a review of the need for the continued imposition of anti-dumping duty on the goods described in the Schedule to this notice.

Anti-dumping duty was imposed by the Minister of Commerce in a notice dated 1 August 1996, published in the New Zealand Gazette of 8 August 1996, and reassessed in notices dated 19 December 1996, published in the New Zealand Gazette of 9 January 1997, and 9 March 1998, published in the New Zealand Gazette of 19 March 1998.

Schedule

Goods Subject to Review

Country of Origin

South Africa

Description of goods

“Canned peaches (halves, slices and pieces) packed in various concentrations of sugar syrup and in can sizes ranging from 110 grams to 3 kilograms (A10)”

Cessation of Anti-dumping Duties on Certain Men’s Footwear From China, Indonesia and Thailand

The Chief Executive of the Ministry of Economic Development gives notice that, in terms of section 14 (9) of the Dumping and Countervailing Duties Act 1988, anti-dumping duties on Certain Men’s Footwear from China, Indonesia and Thailand ceased to be payable with effect from 30 July 2001.

The anti-dumping duties ceased to be payable on that date, because at that date, the goods were not subject to review and 5 years had passed since the date of Notice of Reassessment of duty given, under section 14 (6) of the Dumping and Countervailing Duties Act 1988*, by the Minister of Commerce that the goods were being dumped and were causing material injury to the New Zealand men’s footwear industry.

Dated at Wellington this 30th day of July 2001.

ANNE CORRIGAN, Manager, Trade Remedies Group.

Refer to “Final Determination and Imposition of Anti-Dumping Duty: Certain Men’s Footwear From China, Indonesia, Korea, Taiwan and Thailand Amendment No. 1 (Review and Duty Reassessment)”, published in the New Zealand Gazette* of 1 August 1996 at page 2014.
