Notice of Intention to Request Removal of Company From the Register

Peter Morris Wood, as authorised by the shareholders of Kiwi Pacific Energy Limited, hereby gives notice, pursuant to section 318 (1) (d) (i) of Companies Act 1993 (“the Act”), that he intends to apply to the Registrar of Companies for the removal of Kiwi Pacific Energy Limited, a duly incorporated company having its registered office at Auckland, from the Register of Companies on the grounds that at the date of such request the company has no surplus assets after paying its debts in full or in part, and no creditor has applied to the Court, under section 241 of the Act, for an order putting the company into liquidation.

Any objection, under section 321 of the Act, to the removal of the company from the Register of Companies must be delivered to the Registrar of Companies at Auckland no later than the 31st day of August 2001.
