Notice of Liquidators’ Decision to Dispense With Meeting of Creditors

Pursuant to Section 245 of the Companies Act 1993

We, Paul Francis Lynskey and Gray Traveller, chartered accountants of Christchurch and Wellington respectively, were jointly and severally appointed liquidators of Southway Properties Limited by special resolution of the shareholders on the 9th day of July 2001.

We do not consider that a meeting of creditors should be held because we anticipate being able to pay creditors in full based on the advice we received from the company directors that the company had a surplus of assets over liabilities and was able to pay all its debts at the date of our appointment.

No meeting of creditors will be called unless we receive notice in writing requiring us to hold a meeting of creditors from a creditor within 10 working days of their receipt of this notice.
