Pursuant to Section 6 (2) of the Receiverships Act 1993

Tea Custodians (Equitable) Limited (“the mortgagee”) is the
holder of a first registered mortgage granted by South
Harbour Investments Limited (“the mortgagor”) dated the
22nd day of September 1998, registered with the Registrar
of Companies on the 2nd day of October 1998 and
registered on the 8th day of October 1998 as D. 318713.3
(“the mortgage”) over the land described and comprised in
certificate of title 99D/476 (North Auckland Registry) (“the
property”).

The mortgagee hereby appoints, pursuant to the powers
conferred by clause 6 (b) (iii) of the mortgage, Edwin
George Burnett, property manager of Auckland (“the
receiver”), upon the terms agreed between the mortgagee
and the receiver, to be receiver of the income of the property
charged by the mortgage with all the powers conferred by
clause 6 (g) of the mortgage and by the Receiverships Act
1993 on receivers of income, but so that the receiver shall
not be the agent of the mortgagee.\n
