Treaty of Waitangi Act 1975

This notice concerns 4.1390 hectares of land at Manaia Road, Masterton, and Māori claims under the Treaty of Waitangi Act 1975.

The land at Manaia Road, Masterton, is described in legal terms as all that parcel of land containing 4.1390 hectares more or less situate in the District of Masterton, being Section 107 Manaia District and being all the land comprised in certificate of title 37B/66 (Wellington Registry).

The land was once owned by the Crown. It was transferred to a State-owned enterprise under the State-Owned Enterprises Act 1986.

There is a special notice or “memorial” on the certificate of title for the land which provides that, if the Waitangi Tribunal recommends it, the land shall be resumed by the Crown and returned to Māori ownership (see sections 27A and 27B of the State-Owned Enterprises Act 1986).

The current owner of the land, COLIN LEN TURNER, has applied to the Waitangi Tribunal to have this notice removed. This has been done under section 8D of the Treaty of Waitangi Act 1975.

ANY MĀORI PERSON WHO CONSIDERS THAT THEY, OR ANY GROUP WHICH THEY BELONG TO, HAS A CLAIM TO MAKE TO THE WAITANGI TRIBUNAL ABOUT THIS LAND SHOULD SUBMIT THEIR CLAIM TO THE WAITANGI TRIBUNAL BEFORE THE 28TH DAY OF SEPTEMBER 2001.

Section 6 of the Treaty of Waitangi Act 1975 describes what a claim is. Claims may be posted or sent to the Registrar, Waitangi Tribunal, 110 Featherston Street (P.O. Box 5022), Wellington.

If no claim about this land is made to the Waitangi Tribunal before the 28th day of September 2001, then the tribunal may recommend that the land no longer be liable to be resumed by the Crown and returned to Māori ownership under section 27B of the State-Owned Enterprises Act 1986.

Take notice that on the 27th day of April 2001, an application for putting Stewart Stainless Services Te Aroha Limited into liquidation by the High Court was filed in the High Court at Hamilton.

The application is to be heard before the High Court at Hamilton on Monday, the 9th day of July 2001 at 10.45 a.m.

Any person, other than the defendant company, who wishes to appear on the hearing of the application must file an appearance not later than the second working day before that day.

The plaintiff is BOC Gases New Zealand Limited, whose address for service is at the offices of Receivables Management (NZ) Limited, Sixth Floor, 77 Hereford Street, Christchurch.

Further particulars may be obtained from the office of the Court or from the plaintiff or the plaintiff’s solicitor.
