Conservation and the Commissioner of Crown Lands, acting under a delegation from the Minister for Land Information, being the Minister responsible for the department of State that has control of the land described in the Schedule, jointly declare that the land is held for conservation purposes.

Education Lands Act 1949

Revocation of Province of Otago Education Trust Order 2001

ORDER IN COUNCIL

At Wellington this 2nd day of April 2001

Present:

HER EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT PRESIDING IN COUNCIL

Pursuant to section 15 (5) of the Education Lands Act 1949, Her Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, makes the following order.

Order

  1. Title—This order may be cited as the Revocation of Province of Otago Education Trust Order 2001.

  2. Commencement—This order comes into force on 1 May 2001.

  3. Revocation of Province of Otago Education Trust—By Deed of Grant dated 19 April 1875, the land described in the Schedule was granted to the Superintendent of the Province of Otago under the Public Reserves Act 1854 and 1862 in trust for the establishment and maintenance of a University in the City of Dunedin in the Province of Otago, and of public schools in different parts of the Province, and for the more general advancement of education in the Province, and by section 9 of the Abolition of Provinces Act 1875 the land was vested in Her Majesty the Queen, in trust for those purposes, and the land is no longer required for the purposes for which it is held, therefore the education trust over the land is revoked.

1113 square metres, more or less, being Section 1, Block I, Town of Allanton, Primary Education Reserve, Education Reserves Ordinance 1864. S.O. Plan 14003, Otago Land District – Dunedin City.

Declaring Land to be Held for Conservation Purposes

Under section 7 (1) of the Conservation Act 1987, the Conservator of the Otago Conservancy of the Department of Conservation and the Commissioner of Crown Lands, acting under a delegation from the Minister for Land Information, being the Minister responsible for the department of State that has control of the land described in the Schedule, jointly declare that the land is held for conservation purposes.

Schedule

Otago Land District—Queenstown Lakes District

1004 hectares, more or less, being Section 1, S.O. Plan 24977. Part document 5007921.6. Subject to a grazing permit for a term of 5 years commencing on 27 April 1998 between Her Majesty the Queen, acting through the Commissioner of Crown Lands, and Kevin John Scurr, Mary Diana Scurr, Michael John Scurr and Clare Margaret Scurr, a copy of which may be inspected at the offices of the Department of Conservation at Dunedin.

Under section 26 (5) of the Conservation Act 1987, the Community Relations Manager of the Otago Conservancy of the Department of Conservation gives notice of the disposal in fee simple of the land described in the Schedule for a consideration of $5000.00.

Ngai Tahu Claims Settlement Act 1998

Nohoanga Entitlements

Under section 256 (9) of the Ngai Tahu Claims Settlement Act 1998, the Conservator, Canterbury Conservancy of the Department of Conservation, hereby gives notice that a nohoanga entitlement has been created and granted to Te Runanga o Ngai Tahu, over the land described in the Schedule to this notice.
