On 10 April 2001 at the District Court at Tauranga, Mark Desmond Bennett, of Papamoa Beach Camping Ground, Papamoa Beach Road, Papamoa, was convicted of the following offence – driving while disqualified (subsequent offence) – and in addition to the sentence imposed on him, the Court has ordered that a

Toyota Corolla motor vehicle, registration No. LO 4554 owned by the above-mentioned defendant, be forfeited to Her Majesty, pursuant to section 84 (4) of the Criminal Justice Act 1985.

Dumping and Countervailing Duties Act 1988

Anti-dumping Duties: Notice That Anti-dumping Duties on Canned Apricots From South Africa May Cease to Apply

Under section 14 (9) of the Dumping and Countervailing Duties Act 1988 (“the Act”), anti-dumping duties imposed on canned apricots from South Africa* will cease to apply to those goods on 16 October 2001, unless, at that date, the goods are subject to review under section 14 (8) of the Act.

Any interested party that might request the Chief Executive of the Ministry of Economic Development to initiate a review before the cessation date referred to above, should be aware that positive evidence justifying the need for a review must be provided to the Chief Executive.

If an application is received which provides positive evidence justifying the need for a review, the Chief Executive must undertake and complete a review investigation within 180 days of initiation, on whether the anti-dumping duties should continue to be applied.

Positive evidence justifying the need for a review would need to provide reasons for believing that the expiration of anti-dumping duties would see the continuation or recurrence of dumping of canned apricots from South Africa, and for believing that such dumping would be likely to cause the continuation or recurrence of material injury to the New Zealand industry producing canned apricots.

The reasons should be supported by evidence and not based on mere allegations or assertions.

Provisional Direction:
Household Washing Machines From Korea

Pursuant to section 16 (1) of the Dumping and Countervailing Duties Act 1988 (“the Act”), I hereby give notice that, on the basis of the information made available during the investigation to date:

(1) I have reasonable cause to believe, in relation to the importation of the goods specified in the First Schedule to this notice (hereinafter referred to as the subject goods), that:

(a) the subject goods are being dumped; and
(b) by reason thereof, material injury to the New Zealand industry has been and is being caused;

(2) I am satisfied that action, under section 16 of the Act, is necessary to prevent material injury being caused during the period of investigation.

Pursuant to section 16 (1) of the Act, I hereby give notice of a provisional direction that payment of the rate of anti-dumping duty set out in the Second Schedule to this notice, in respect of the subject goods, shall be secured in accordance with sections 156 and 157 of the Customs and Excise Act 1996.

Household fully automatic washing machines with a dry linen capacity not exceeding 10 kilograms, the capacity determined by standard AS/NZS2040.

The goods are currently classified under Tariff Item 8450.11.01 and Statistical Keys 02H, 05B, 07J and 11G of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.

Amount of Anti-Dumping Duty to be Secured
The rate of anti-dumping duty to be secured in respect of the subject goods, imported or intended to be imported into New Zealand from Korea from the suppliers listed below, shall be the rate specified below in respect of that supplier calculated as a percentage of the declared value for duty of the subject goods:
