Direction on Advance Payment of Benefits Amendment 2001

To: The Chief Executive of the Department of Work and Income

Pursuant to section 5 of the Social Security Act 1964, the Minister of Social Services and Employment makes the following Amendment to the Direction on Advance Payment of Benefits given on 25 May 1999.

Amendment

  1. Title—(1) This is the Direction on Advance Payment of Benefits Amendment 2001.

(2) In this Amendment, the Direction on Advance Payment of Benefits is called “the direction”.

  1. Commencement—This Amendment comes into effect on 1 April 2001.

  2. Safety Footwear—Clause 7.2.1 of the direction is amended by revoking paragraph (a), and substituting the following paragraph:

“(a) is, under section 111 of the Act,—

“(i) directed to participate in any Organised Activity that involves undertaking work; or

“(ii) requested to participate in any activity in the community (within the meaning of section 110 (3) (ha) (i) of the Act) that involves undertaking work and has agreed to do so; and”

Explanatory Note:
This note is not part of the Amendment, but is intended to explain its general effect.

This Amendment to the Ministerial direction on advance payment of benefits, is consequential on the Social Security Amendment Act 2001.

Part 1 of that Act, which comes into force on 1 April 2001, replaces the organised activity “community work” with “activity in the community”, in which participation may be requested rather than directed.

The provisions of the direction relating to safety footwear are amended with effect 1 April 2001 consequentially on those changes.

Revocation of Disability Assistance Programme

Pursuant to section 124 (1) (d) of the Social Security Act 1964, the Minister of Social Services and Employment, by this instrument, which takes effect on 1 April 2001, revokes the Disability Assistance Programme 2000 (as established and approved on 18 December 2000).

The Public Trust Office (Investment Agencies in Common Fund) Notice 5 April 2001

The following notice is given pursuant to section 37 of the Public Trust Office Act 1957 and sections 29 and 41 of the State Sector Act 1988.

Notice

  1. Title and commencement—This notice may be cited as the Public Trust Office (Investment Agencies in the Common Fund) Notice 5 April 2001 and shall take effect from and including 5 April 2001.

  2. Interest rates on investment agencies—The rate of interest that may be paid by the Public Trustee on moneys invested by the Public Trustee as agent of any principal in the common fund of the Public Trust Office (referred to in this notice as “agencies”) pursuant to section 37 of the Public Trust Office Act 1957 shall, for the following terms and inclusive dollar ranges, be:

(a) At call 4.25
(b) For a fixed term of 3 months:
(i) For the range $5,000 to $9,999 5.50
(ii) For the range $10,000 to $49,999 5.75
(iii) For the range $50,000 to $249,999 5.80
(iv) For the range above $249,999 5.85
(c) For a fixed term of 6 months:
(i) For the range $5,000 to $9,999 5.45
(ii) For the range $10,000 to $49,999 5.55
(iii) For the range $50,000 to $249,999 5.60
(iv) For the range above $249,999 5.65
(d) For a fixed term of 9 months:
(i) For the range $5,000 to $9,999 5.35
(ii) For the range $10,000 to $49,999 5.40
(iii) For the range $50,000 to $249,999 5.45
(iv) For the range above $249,999 5.50
(e) For a fixed term of 12 months:
(i) For the range $5,000 to $9,999 5.25
(ii) For the range $10,000 to $49,999 5.35
(iii) For the range $50,000 to $249,999 5.40
(iv) For the range above $249,999 5.50
  1. Transitional provisions—(1) Paragraph 2 of this notice shall not apply to any interest payable in respect of the period that ends with 4 April 2001.

(2) Paragraph 2 (a) of this notice shall apply:

(i) to agencies that commenced prior to 5 April 2001, as from that date;

(ii) to agencies that commenced on or after 5 April 2001, as from the date of their commencement.

(3) Paragraphs 2 (b) to 2 (e) inclusive of this notice:

(i) shall not apply to agencies that commenced prior to 5 April 2001; but
