Pursuant to section 114 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Stephen Robert Gilbert, Land Information New Zealand, declares the land described in the Schedule to this notice to be road which, pursuant to section 88 (2) of the Transit New Zealand Act 1989, becomes road, limited access road and State highway and shall vest in the Crown on the date of publication of this notice in the New Zealand Gazette.

Land Acquired for Better Utilisation—Tinakori Hill, Wellington

Pursuant to section 20 (1) of the Public Works Act 1981 ("the Act"), and to a delegation from the Minister of Lands, Stephen Robert Gilbert, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the land in the First Schedule ("the land") is hereby acquired for better utilisation and is vested in the Wellington City Council ("the council") from the date of publication of this notice in the New Zealand Gazette, subject to the fencing covenant in the Second Schedule and subject to section 27B of the State-Owned Enterprises Act 1985.

Second Schedule

Fencing Covenant

The vesting of the land is subject to the condition that Telecom New Zealand Limited, being the registered proprietor of land adjoining the land being described as Section 1 on S.O. Plan 38299, being part of the land in certificate of title 38D/543 (Wellington Registry) ("the Telecom land"), and the council shall be bound by a fencing covenant under the Fencing Act 1978 in favour of each other so that neither party shall be bound to contribute towards the cost of work on the fence on the boundary between the land and the Telecom land, but that covenant will not enure for the benefit of any purchaser of land which has the benefit of the covenant.

Reserves Act 1977

Declaration That Land is a Reserve and Classification of Reserves

In exercise of the powers conferred on it by delegation under the Reserves Act 1977, the Manawatu District Council notifies the following resolution passed by the council on 21 September 2000:

"That under section 14 of the Act, the Manawatu District Council resolves to declare that the land held in fee simple by the council and described in the First Schedule to be recreation reserves, subject to section 17 of the Act; and the land held in fee simple by the council and described in the Second Schedule to be scenic reserves, subject to section 19 (1) (a) of the Act; and the land held in fee simple by the council and described in the Third Schedule to be local purpose (community purposes) reserves, subject to section 23 of the Act; and the land held in fee simple by the council and described in the Fourth Schedule to be recreation reserves, subject to section 17 of the Act."
