apparatus intended for, associated with, or ancillary
to, radiocommunication or telecommunication;

(b) "Fixed radio station", "radio apparatus",
"radiocommunication" and "telecommunication"
have the same meanings as in section 2 (1) of the
Telecommunications Act 1987;

(c) "Network" means the system of radiocommunication
or telecommunication facilities which Radio
New Zealand Limited operates or uses, or may in
future operate or use, for the purpose of
radiocommunication or telecommunication;

(d) "Predecessors" includes Broadcasting Corporation of
New Zealand and New Zealand Public Radio
Limited.

(2) In this notice, any reference to an enactment is deemed
to include a reference to all subsequent enactments passed in
amendment or substitution for that enactment.

3. Approval as requiring authority for every project or

work relating to designations and related processesβ€”

(1) Radio New Zealand Limited is approved as a requiring
authority, under section 167 of the Resource Management
Act 1991, for every project or work for which:

(a) a designation is included or is deemed to be included
in a district plan, or must be included in a district
plan in accordance with section 420 (2) (b) of the
Resource Management Act 1991, and Radio
New Zealand Limited or its predecessors has been or
is the requiring authority or Radio New Zealand
Limited could be the requiring authority; or

(b) written notice could have been or has been given by
Radio New Zealand Limited or its predecessors, or
could be given by Radio New Zealand Limited, as
the requiring authority for a designation, to a
territorial authority requiring the designation to be

included in the proposed district plan, with or without
modification, under clause 4 of the First Schedule to
the Resource Management Act 1991 (or under the
former section 183 of that Act); or

(c) a notice of requirement has been given by Radio
New Zealand Limited or its predecessors, or could be
given by Radio New Zealand Limited under section
168 of the Resource Management Management Act 1991; or

(d) provision is included in a proposed district plan
(including any change or variation) for any
designation and Radio New Zealand Limited or its
predecessors has been or is the requiring authority for
that designation; or

(e) a designation is included in a district plan, and Radio
New Zealand Limited or its predecessors has been or
is the requiring authority for that designation.

4. Approval as requiring authority in respect of other

projects or worksβ€”(1) Radio New Zealand Limited is
approved as a requiring authority, under section 167 of the
Resource Management Act 1991, for every project or work
for:

(a) any radiocommunication or telecommunication
facility of the network of Radio New Zealand
Limited or of any network of any of its predecessors;
and

(b) the operation, erection, installation, maintenance,
replacement, alteration, improvement, removal and
other use, including ancillary use, of land (within the
meaning of section 9 (4) of the Resource
Management Act 1991) in respect of any such
radiocommunication or telecommunication facility.
