Notice of Disciplinary Action Taken by the Electrical Workers Registration Board

The Registrar of the Electrical Workers Registration Board (“the board”), having been directed by the board, in accordance with section 139 of the Electricity Act 1992, gives notice of the following registered electrical worker having been disciplined by the board, under part XI of the Electricity Act 1992, and the effect of the decision or order of the board:

Patrick Searle, of Dunedin, had his electrician’s registration restricted for a period of 3 months. The restriction is that Patrick Searle is limited in the work he is able to carry out by being required to keep a diary, in a form prescribed by the Registrar of the Board, of all testing for prescribed electrical work carried out over a period of 3 months commencing from the next instance when such work is undertaken.

Patrick Searle is required to submit, on a monthly basis to the Deputy Registrar, a copy of those test records. Patrick Searle was ordered to pay costs of seven hundred and fifty dollars ($750). The costs to be paid by 9 February 2001.

Resource Management (Approval of The Radio Network Limited as Requiring Authority) Notice 2001

Pursuant to section 167 of the Resource Management Act 1991, the Minister for the Environment gives the following notice.

Notice

  1. Title and commencement—(1) This notice is the Resource Management (Approval of The Radio Network Limited as Requiring Authority) Notice 2001.

(2) This notice comes into force on the 28th day after the date of its publication in the New Zealand Gazette.

  1. Interpretation—(1) In this notice, unless the context otherwise requires:

(a) “Radiocommunication or telecommunication facility” means any line, cable, mast, pole, aerial, tower, antenna, dish, fixed radio station, radio apparatus, or other building, structure, facility or apparatus intended for, associated with, or ancillary to, radiocommunication or telecommunication;

(b) “Fixed radio station”, “radio apparatus”, “radiocommunication” and “telecommunication” have the same meanings as in section 2 (1) of the Telecommunications Act 1987;

(c) “Network” means the system of radiocommunication or telecommunication facilities which The Radio Network Limited operates or uses, or may in future operate or use, for the purpose of radiocommunication or telecommunication;

(d) “Predecessors” includes Broadcasting Corporation of New Zealand, the company known until 30 November 1995 as Radio New Zealand Limited, The Radio Company Limited, The Radio Network of New Zealand Limited, The Radio Network – Northern Limited, The Radio Network – Central Limited and The Radio Network – Southern Limited.

(2) In this notice, any reference to an enactment is deemed to include a reference to all subsequent enactments passed in amendment or substitution for that enactment.

  1. Approval as requiring authority for network utility operation—(1) The Radio Network Limited is approved as a requiring authority, under section 167 of the Resource Management Act 1991, for the network utility operation described in subclause (2).

(2) The network utility operation is:

(a) the network of The Radio Network Limited, or any network of any of its predecessors, that The Radio Network Limited operates or proposes to operate for the purpose of radiocommunication or telecommunication, including any radiocommunication or telecommunication facility of The Radio Network Limited’s network or of any network of any of its predecessors; and

(b) the operation, erection, installation, maintenance, replacement, alteration, improvement, removal and other use, including ancillary use, of land (within the meaning of section 9 (4) of the Resource Management Act 1991) for any such network.
