Public Trust Office Act 1957

The Public Trust Office (Investment Agencies in Common Fund) Notice 15 November 2001

The following notice is given pursuant to section 37 of the Public Trust Office Act 1957 and sections 29 and 41 of the State Sector Act 1988.

Notice

  1. Title and commencement—This notice may be cited as the Public Trust Office (Investment Agencies in the Common Fund) Notice 15 November 2001 and shall take effect from and including 15 November 2001.

  2. Interest rates on investment agencies—The rate of interest that may be paid by the Public Trustee on moneys invested by the Public Trustee as agent of any principal in the common fund of the Public Trust Office (referred to in this notice as “agencies”) pursuant to section 37 of the Public Trust Office Act 1957 shall, for the following terms and inclusive dollar ranges, be:

Term and (where applicable) Dollar Range % interest rate p.a.
(a) At call 3.25
(b) For a fixed term of 3 months:
(i) For the range $5,000 to $9,999 4.50
(ii) For the range $10,000 to $49,999 4.60
(iii) For the range $50,000 to $249,999 4.65
(iv) For the range above $249,999 4.65
(c) For a fixed term of 6 months:
(i) For the range $5,000 to $9,999 4.40
(ii) For the range $10,000 to $49,999 4.50
(iii) For the range $50,000 to $249,999 4.55
(iv) For the range above $249,999 4.55
(d) For a fixed term of 9 months:
(i) For the range $5,000 to $9,999 4.40
(ii) For the range $10,000 to $49,999 4.50
(iii) For the range $50,000 to $249,999 4.55
(iv) For the range above $249,999 4.55
(e) For a fixed term of 12 months:
(i) For the range $5,000 to $9,999 4.40
(ii) For the range $10,000 to $49,999 4.50
(iii) For the range $50,000 to $249,999 4.55
(iv) For the range above $249,999 4.55
  1. Transitional provisions—(1) Paragraph 2 of this notice shall not apply to any interest payable in respect of the period that ends with 14 November 2001.

(2) Paragraph 2 (a) of this notice shall apply:

(i) to agencies that commenced prior to 15 November 2001, as from that date;

(ii) to agencies that commenced on or after 15 November 2001, as from the date of their commencement.

(3) Paragraphs 2 (b) to 2 (e) inclusive of this notice:

(i) shall not apply to agencies that commenced prior to 15 November 2001; but

(ii) shall apply to agencies that commence on or after 15 November 2001, as from the date of their commencement.\n
4. Revocation—The Public Trust Office (Investment Agencies in Common Fund) Notice 8 November 2001, New Zealand Gazette, page 3786, is hereby revoked.

Notice of Disclaimer Under Section 338 of the Companies Act 1955

In the matter of the Land Transfer Act 1952 and in the matter of section 338 of the Companies Act 1955, and in the matter of Cosy Homes Limited:

Take notice that I, Dr Alan Esmond Bollard, Secretary to the Treasury, pursuant to section 338 of the Companies Act 1955, hereby disclaim for and on behalf of Her Majesty the Queen, all right, title and interest of Her Majesty the Queen in an estate in fee simple in all that parcel of land containing seventy eight square metres (78m²), more or less, being Lot 192 on Deposited Plan 56796 and being part Allotment 54, Section 1, Small Lots near Village of Howick, and being all the land comprised and described in certificate of title 10C/763, North Auckland Land Registry, being a property formerly held by Cosy Homes Limited, a company removed from the Companies Register on 13 December 1978 and formerly having its registered office at Papatoetoe.

And I certify that the vesting of the said properties did not come to my notice until 25 September 2001.

Earthquake Commission Act 1993

Pursuant to section 12 of the Earthquake Commission Act 1993:

(i) This direction comes into effect on 1 November 2001 and as of that date, the direction dated 2 June 1998 is hereby revoked.
