(c) that BDO Spicers Auckland Trustee Company Limited does not at any time control or have the right to control, directly or indirectly, the issuer or any manager of a scheme in respect of which it acts as a trustee or statutory supervisor, otherwise than in connection with the performance of its functions and powers as a trustee or statutory supervisor;
(d) that BDO Spicers Auckland Trustee Company Limited does not at any time hold any participatory securities issued by the issuer or any manager of a scheme in respect of which it acts as a trustee or statutory supervisor;
(e) that no relationship exists at any time between BDO Spicers Auckland Trustee Company Limited and the issuer or any manager of a scheme in respect of which it acts as a trustee or statutory supervisor, that affects, or is likely to affect, BDO Spicers Auckland Trustee Company Limited’s ability to perform its functions and powers as a trustee or statutory supervisor;
(f) that BDO Spicers Auckland Trustee Company Limited maintains satisfactory professional indemnity insurance in respect of the exercise of its functions and powers as a trustee and statutory supervisor; and
(g) that if the majority of directors of BDO Spicers Auckland Trustee Company Limited change from those appointed as directors of the company at 24 September 2001, the notice will no longer apply.
- Pursuant to section 48 of the Securities Act 1978, the Securities Commission revokes:
(a) BDO Auckland Trustee Company Limited’s approval to act as a statutory supervisor in respect of participatory securities to be offered to the public for subscription by WorldWide Resorts (New Zealand) Limited dated 26 September 2000; and
(b) BDO Hogg Young Cathie Trustee Company Limited’s approval to act as a statutory supervisor in respect of participatory securities to be offered to the public for subscription by Lako Mai Resort (New Zealand) Limited dated 14 March 1997.

Ngāi Tahu Claims Settlement Act 1998
Background
On 21 November 1997, the Crown and Te Rūnanga O Ngāi Tahu entered into a Deed of Settlement, setting out the terms of the settlement reached to give effect to the claims made by Te Rūnanga O Ngāi Tahu. The major part of the settlement was related to the main claim on behalf of the Ngāi Tahu iwi. However, minor claims that related to individual hapu or whanau were set aside and responsibility given to a special Trust set up for the purpose to vest these minor claims in the descendants of the original owners of the land or fisheries reserves alienated in some cases over 100 years ago.
Ancillary Claim Properties
There are 32 individual claim properties, 9 of which are all based on customary fishing areas. The total assessed value of the 32 properties is a little over $1,000,000.00, but the cultural value is of lasting significance to Ngāi Tahu descendants.
Research
The Ancillary Claims Trust was established in November 1998 and, since then, the priority has been to carry out the necessary research to establish the original owners. This research has now been completed and this notice is the first of three notices to locate the descendants of the original owners in three groups of areas.
Properties to be Vested
The claim properties being dealt with in this first batch are ancillary claims in Otago (Otakou) and Southland (Murihiku). Please note that the following reserves are compensation lands. They differ from the reserves of the same name found in the Māori Land Court Records.
These lands are scattered extensively throughout Otakou (Otago) and Murihiku (Southland) at Lake Hawea, Lake Waipouri, Wilsher Bay, Riverton, Invercargill, Otakou Peninsula, and the Hedgehope transmitter site.
