3. Except so modified herein, the terms relating to right of ways set out in the Seventh Schedule of the Land Transfer Act 1952 and the Ninth Schedule of the Property Law Act 1952, shall apply to the easement herein.

Road Realignment—State Highway No. 25, Te Rerenga Kuaotunu Road, Thames-Coromandel District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, R. J. Sutherland, Land Information New Zealand—

(a) Pursuant to section 114, declares the land described in the First Schedule to this notice to be road which, pursuant to section 60 (2) of the Transit New Zealand Act 1989, forms part of State Highway No. 25 and shall vest in the Crown on the date of publication of this notice in the New Zealand Gazette.

(b) Declares the land in the Second Schedule to this notice to be taken under section 119 (1) and remain vested in the Crown.

(c) Declares the land in the Third Schedule to this notice to be taken under section 119 (1) and shall be amalgamated and, further, declares that:

(i) Area marked “K” on S.O. Plan 60724 shall be amalgamated with the land in certificate of title 69A/758.

(ii) Section 1, S.O. Plan 60730 shall be amalgamated with the land in certificate of title 68C/688.

(iii) Area marked “M” on S.O. Plan 60737 shall be amalgamated with the land in certificate of title 63B/646, subject to mortgage B. 557951.2.

(d) Pursuant to sections 116 (1), 117 (3), 117 (6) and 120 (3) of the Public Works Act 1981, declares the road described in the Fourth Schedule to this notice to be stopped and amalgamated with the land in Crown Forestry Licence 49C/450.

(e) Pursuant to sections 117 (3), 117 (6) and 120 (3) of the Public Works Act 1981, declares the severance described in the Fifth Schedule to this notice to be amalgamated with the land in Crown Forestry Licence 49C/450.
