Easement to Drain Sewage from Dairy Flat School, Rodney District

Pursuant to section 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, declares that, an agreement to that effect having been entered into, a sewage drainage easement is acquired over the land described in the First Schedule, subject to the rights and powers contained in paragraphs 4 and 5 of the Seventh Schedule of the Land Transfer Act 1952, and as modified by the terms and conditions contained in the Second Schedule to this notice and shall vest in the Crown on the date of publication of this notice in the New Zealand Gazette.

Second Schedule

Additional Terms and Conditions Relating to the Easement

(i) The easement shall be limited as to duration to a period of ten (10) years, such term to expire on 31 December 2008.

(ii) The rights implied by the within easement shall only be available to the Crown as grantee.

(iii) For the duration of the easement, the Crown shall have exclusive and undisturbed use of the easement area and the owner shall not do or permit anything which would or could damage, endanger or affect the operation of the waste water disposal field.

(iv) Upon expiration of the easement or its earlier surrender by the Crown, the Crown will release the owner from this agreement and discharge any compensation certificate or extinguish any easement registered against the owner’s certificate of title.
