Fisheries (Quota Aggregation Limit Exemption) Notice (No. 2) 2000 (No. F159)

Pursuant to section 28W (3) of the Fisheries Act 1983, the Minister of Fisheries, after consultation with the New Zealand Fishing Industry Board and the Treaty of Waitangi Fisheries Commission, and after having regard to the provisions of section 28W (5) of the Fisheries Act 1983, hereby gives the following notice.

Notice

  1. Title and Commencement—(1) This notice may be cited as the Fisheries (Quota Aggregation Limit Exemption) Notice (No. 2) 2000.

    (2) This notice shall come into effect on the date of its notification in the New Zealand Gazette.

  2. Exemption to quota aggregation limit—(1) As from the date that this notice comes into effect, Chatham Quota Owner Limited is permitted to hold quota and interest in quota in excess of the 10 percent aggregation limit for rock lobster in quota management area 6, as provided in section 28W (1) of the Fisheries Act 1983, up to an aggregation limit of 22.15 percent.

    (2) As from the date that this notice comes into effect, Chatham Island Packing Co Limited is permitted to hold quota by lease only in excess of the 10 percent aggregation limit for rock lobster in quota management area 6 as provided in section 28W (1) of the Fisheries Act 1983, up to an aggregation limit of 22.62 percent.

Fisheries (South Island Customary Fishing) Regulations 1999

Fisheries (South Island Customary Fishing) Notice (No. 20) 2000 (No. F156)

Pursuant to Regulation 10 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister of Fisheries hereby gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 20) 2000.

    (2) This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.

  2. Interpretation—In this notice:

    (a) The term “Customary food gathering” has the same meaning as defined in the Fisheries (South Island Customary Fishing) Regulations 1999.

    (b) Any reference to “Tangata Tiaki/Kaitiaki” means the person or persons appointed under Regulation 9 or 10 of the Fisheries (South Island Customary Fishing) Regulations 1999 as Tangata Tiaki/Kaitiaki for the area/rohe moana.

    (c) Any reference to area/rohe moana means the area from Abut Head to Piopiotahi; inland to the boundaries defined for Te Rūnanga o Te Rūnga Te Keoti Tūranga in the Te Rūnanga o Ngāi Tahu Act 1996; extending seaward to the limit of the South Island fisheries waters as defined under Regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1999, being the 200 mile limit; returning to the first mentioned point.

  3. Cancellation of Tangata Tiaki/Kaitiaki—Te Rūnanga o Ngāi Tahu, acting on the behalf of Te Rūnanga o Makaawhio, being the Tangata Whenua who nominated Tangata Tiaki/Kaitiaki, cancels the appointment of the existing Tangata Tiaki/Kaitiaki.
