Notice of Review of Need for Continued Imposition of Anti-Dumping Duty: Automotive Oil Filters From the United States of America
I hereby give notice that, pursuant to section 14 (8) of the Dumping and Countervailing Duties Act 1988, and under delegated authority from the Secretary of Commerce, I have initiated a review of the need for the continued imposition of anti-dumping duty on the goods described in the Schedule to this notice. Anti-dumping duty was imposed by the Minister of Commerce in a notice dated 27 November 1992, published in the New Zealand Gazette of 3 December 1992, and reassessed in notices dated 3 July 1994, published in the New Zealand Gazette of 14 July 1994 and 8 April 1996, published in the New Zealand Gazette of 23 April 1996.

The goods are currently classified under Tariff Item and Statistical Key 8421.23.00.01B of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.

The review will also consider amendments, for the purpose of clarification, to the description of goods should the review determine that there is a continued need for the imposition of anti-dumping duties.

Initiation of Dumping Investigation: Oil Filters From Indonesia, Korea and Thailand
Notice is hereby given that, acting pursuant to section 10 (1) of the Dumping and Countervailing Duties Act 1988, and under delegated authority from the Secretary of Commerce, I have initiated an investigation to determine both the existence and effect of the alleged dumping of the goods described in the Schedule to this notice, originating from Indonesia, Korea and Thailand, being satisfied that sufficient evidence has been provided that:
(a) The goods imported or intended to be imported into New Zealand are being dumped; and
(b) By reason thereof there is a threat of material injury to the New Zealand industry producing like goods,
and also being satisfied that the collective output of those New Zealand producers who have, in writing, expressed support for the application constitutes:
(a) Twenty-five percent or more of total New Zealand production of like goods produced for domestic consumption (assessed during the most recent representative period, being not less than 6 months); and
(b) More than 50 percent of the total production of like goods produced for domestic consumption (as so assessed) by those New Zealand producers who have, in writing, expressed support for or opposition to the application.

Description of Goods
Lubricating oil filters (including elements) for use on internal combustion engines, including off-road, commercial and industrial applications but EXCLUDING:
- Lubricating oil filters (including elements) solely manufactured for use on;
- internal combustion engines of less than 20 horsepower;
- stationary engines (internal combustion types);
- motorcycles;
- aircraft;
- marine engines; and
- cartridge/element type filters having dimensions greater than 467mm in length or 400mm in outside diameter;
- spin-on type filters having dimensions greater than 300mm in length or 123mm in outside diameter.
The goods are currently classified under Tariff Item 8521.23.00 and Statistical Key 01B of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.
