Communications Limited ("BCL") advising the registered proprietors of its intention to dispose of its interest, and if the option is not exercised in that time, Broadcast Communications Limited ("BCL") may then dispose of it as it sees fit, BUT if any other proposed disposal of the land in the First Schedule, is for consideration less than the current market valuation, the proprietors of the land in certificate of title 55A/955 (the servient land) shall again be given a reasonable opportunity to acquire the land for similar consideration.

7. Broadcast Communications Limited ("BCL") acknowledges that it is a condition of the grant of easement herein conferred that Telecom Corporation of New Zealand and its subsidiary companies and successors shall not be permitted to use or otherwise have the benefit thereof.

8. Broadcast Communications Limited ("BCL") shall at its own cost establish a gate at the start of the right of way contiguous to the public road. The said gate shall be kept locked at all times (except during passage) and keys provided to permitted and identified users. Keys shall also be provided to the registered proprietors of the land in certificate of title 55A/955 (the servient land) for their own use at no cost to themselves.

Land Acquired for a Local Purpose Reserve (Waterway)—Dyers Road/Linwood Avenue, Christchurch

Pursuant to section 20 (1) and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Kerry John Twydle, Land Information New Zealand, declares that, an agreement to that effect having been entered into:

(a) The land described in the First Schedule hereto is hereby acquired for a local purpose reserve (waterway), subject to the Reserves Act 1977, and subject also to the right to drain water as specified in easement certificate 514172/10, and shall vest in the Christchurch City Council on the date of publication hereof in the New Zealand Gazette.

(b) A water drainage easement in gross as defined in the Seventh Schedule of the Land Transfer Act 1952, is acquired over the land described in the Second Schedule of this notice and is vested in the Christchurch City Council on the date of publication hereof in the New Zealand Gazette.

Road Realignment in the Queenstown Lakes District—Coal Pit Road, Gibbston

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, Kerry John Twydle, Land Information New Zealand:

(a) Pursuant to sections 20 (1) and 114, declares that, pursuant to an agreement to that effect having been entered into, the land described in the First Schedule to this notice is acquired for road and shall vest in the Queenstown Lakes District Council on the date of publication of this notice in the New Zealand Gazette.

(b) Pursuant to section 119, declares the land described in the Second Schedule to this notice to be taken and amalgamated with the land in C.T. Ref. 17A/257, subject to section 241 (2) of the Resource Management Act 1991 (conditions of consent), an encumbrance to Gibbston Valley Irrigation Limited by transfer 962007.65 and certificate under section 417 (2) of the Resource Management Act 1991 by transfer 967675.1.

(c) Pursuant to sections 116 (1), 117 (3) and 120 (3), declares the road described in the Third Schedule to this notice to be stopped and when stopped, to be amalgamated with the land in C.T. Ref. 17A/257, subject to section 241 (2) of the Resource Management Act 1991 (conditions of consent), an encumbrance to Gibbston Valley Irrigation Limited by transfer 962007.65 and certificate under section 417 (2) of the Resource Management Act 1991 by transfer 967675.1.
