Land Required for Soil Conservation and River Control Purposes and Right of Way Easement, Karamu Stream, Whakatu, Hastings District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, declares:

(a) Pursuant to section 20 (1), that an agreement to that effect having been entered into, the land described in the First Schedule to this notice is acquired for soil conservation and river control purposes, subject to transfer 66211 drainage and sewerage rights, transfer 634572.1 convey gas and petroleum product rights and construct pipeline easements in gross, transfer 697749.2 convey electric power rights, and is vested in the Hawke’s Bay Regional Council on the date of publication of this notice in the New Zealand Gazette.

(b) An easement for a right of way is acquired for soil conservation and river control purposes over the land in the Second Schedule, which shall be subject to the terms and conditions in the Third Schedule, and shall vest in the Hawke’s Bay Regional Council on the date of publication hereof in the New Zealand Gazette (and may be surrendered at any time by notice in the New Zealand Gazette). This easement is to be forever appurtenant to the land in the First Schedule.
