1. This is a notice of withdrawal of a public ruling made under section 91D of the Tax Administration Act 1994.

2. Public ruling BR Pub 00/09 is hereby withdrawn.

3. Public ruling BR Pub 00/09 applied for the period 1 April 2000 to 31 March 2005.

4. Public ruling BR Pub 00/09 is withdrawn on and from 26 October 2000.

Notice of Public Ruling

1. This is a notice of a public ruling made under section 91D of the Tax Administration Act 1994.

2. Public ruling BR Pub 00/11 entitled “Directors’ fees and G.S.T.” was issued on 26 October 2000. The ruling’s subject matter was originally contained in BR Pub 00/09, issued on 29 August 2000 for the period 1 April 2000 to 31 March 2005. BR Pub 00/09 appeared in Inland Revenue’s Tax Information Bulletin, Vol. 12, No. 9, September 2000. As it was not the Commissioner’s intention that BR Pub 00/09 should include a retrospective period, that ruling has been withdrawn. BR Pub 00/11 covers the period 26 October 2000 to 31 March 2005.

3. A copy of the ruling may be obtained by writing to the Assistant General Manager (Adjudication & Rulings), National Office, Inland Revenue, P.O. Box 2198, Wellington.

Transit New Zealand Act 1989

Transit New Zealand Functions and Duties Notice 2000

Pursuant to section 6(e) of the Transit New Zealand Act 1989, the Minister of Transport gives the following notice.

Notice

1. Title—This notice is the Transit New Zealand Functions and Duties Notice 2000.

2. Commencement—This notice comes into force on 1 November 2000.

3. Application—This notice applies to Transit New Zealand (which is constituted under section 4 of the Transit New Zealand Act 1989).

4. Additional functions and duties—Transit New Zealand is empowered to carry out the functions of controlling and managing roads vested in the Marlborough District Council and, in relation to those roads, may undertake any duties which may lawfully be conferred on Transit New Zealand by statute or by the Marlborough District Council.

Explanatory Note:

This note is not part of the notice, but is intended to indicate its general effect.

This notice prescribes additional functions and duties for Transit New Zealand to carry out in relation to roads vested in the Marlborough District Council. The requirement for the notice has arisen as a result of the council’s wish to enter into a contract with Transit New Zealand for the management and control of its roads.
