Amending a Notice Realigning Road in Otago Districts—State Highway No. 87, Capburn

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, hereby amends the notice dated 13 January 1999, realigning road, published in the New Zealand Gazette of 21 January 1999, No. 4 at page 129 by substituting (ii) of the recital with:

“(ii) Pursuant to sections 116 (1) and 117 (7) of the Public Works Act 1981, the road described in the Second Schedule to be stopped and vested into Crown land reserved from sale (marginal strip), pursuant to section 58 of the Land Act 1948.”

Further, at the top of the Second Schedule, substituting “Being” for “Adjoining”.

Amending a Notice Realigning a Road

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, R. J. Sutherland, Land Information New Zealand, hereby amends the notice dated 7 September 1999, vesting stopped road, published in the New Zealand Gazette of 16 September 1999, No. 123 at page 2949 by deleting from within the recital, reference to David John Ramsey, farm worker of Kaikohe, and substituting the following:

David John Ramsey, Graeme John Nelson and Walter Mick George Yovich.

Road Realignment—SH1 Hillgrove, Waitaki District, Otago

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, Stephen Robert Gilbert, Land Information New Zealand,

(a) Pursuant to Section 114 (1), declares the land described in the First Schedule to this notice to be road and remains vested in the Crown on the date of publication hereof in the New Zealand Gazette.

(b) Pursuant to Section 20 (1), declares that pursuant to an agreement to that effect having been entered into the land described in the Second Schedule to this notice to be acquired for road which pursuant to Section 60 (2) of the Transit New Zealand Act 1989 shall form part of State Highway No 1 and shall vest in the Crown on the date of publication hereof in the New Zealand Gazette.

(c) Pursuant to Section 20 (1), declares that pursuant to an agreement to that effect having been entered into the land described in the Third Schedule to this notice to be acquired for road and shall vest in the Waitaki District Council on the date of publication hereof in the New Zealand Gazette.

(d) Pursuant to Sections 116 (1), 117 (3) and 120 (3), declares:

(i) (a) Area 1 shall be amalgamated with the land in certificate of title 147/48 subject to mortgages 786269.6 and 786269.7.

(i) (b) Areas 2 and 3 shall be amalgamated with the land in certificate of title 7D/1369 subject to mortgage 751948.

(i) (c) Areas 4 and 7 shall be amalgamated with the land in certificate of title 281/8 subject to mortgage 449012.4.

(i) (d) Areas 5 and 6 shall remain vested in the Crown.

(ii) the portions of road described in the Fourth Schedule to this notice to be stopped and further declares:

(ii) (a) Areas 1 and 3 shall be amalgamated with the land in certificate of title 147/48 subject to mortgages 786269.6 and 786269.7.

(ii) (b) Area 2 shall be amalgamated with the land in certificate of title 238/153 subject to mortgages 786269.6 and 786269.7.

(ii) (c) Area 4 shall be amalgamated with the land in certificate of title 7D/1369 subject to mortgage 751948.

(ii) (d) Area 5 shall remain vested in the Crown..

(ii) (e) Area 6 shall be amalgamated with the land in certificate of title 281/8 subject to mortgage no. 449012.4.

(e) Declares the land in the Fifth Schedule to this notice to be taken under Section 119 (1) and further declares:

(i) Area 1 shall be amalgamated with the land in certificate of title 238/153 subject to mortgages 786269.6 and 786269.7.

(ii) Area 2 and 3 shall be amalgamated with the land in certificate of title 147/48 subject to mortgages 786269.6 and 786269.7.

(iii) Area 4 shall be amalgamated with the land in certificate of title 7D/1369 subject to mortgage 751948.

(f) Pursuant to Section 52 declares that the land described in the Sixth Schedule to this notice is set apart for road which pursuant to Section 60 (2) of the Transit New Zealand Act 1989 shall form part of State Highway No 1 and shall remain vested in the Crown on the date of publication of this notice in the New Zealand Gazette.

(g) Pursuant to Section 52 declares that the land described in the Seventh Schedule to this notice is set apart for road and shall vest in the Waitaki District Council on the date of publication of this notice in the New Zealand Gazette.
