Pursuant to section 22 (1) of the Citizens Initiated Referenda Act 1993, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and following the presentation to the House of Representatives on 13 July 1999 of an indicative referendum petition, which had been promoted by Mr Norm Withers and which had been certified correct under section 18 (1) (a) of that Act, makes the following order.

Order

1. Title and commencement—(1) This order may be cited as the Citizens Initiated Referendum (Appointed Day) Order (No. 2) 1999.

(2) This order comes into force on the day after the date of its publication in the Gazette.

2. Appointed day—Saturday, 18 December 1999, is appointed as the day on which an indicative referendum is to be held under the Citizens Initiated Referenda Act 1993 on the following question:

Should there be a reform of our justice system placing greater emphasis on the needs of victims, providing restitution and compensation for them and imposing minimum sentences and hard labour for all serious violent offences?

Explanatory Note

This note is not part of the order, but is intended to indicate its general effect.

This order appoints Saturday, 18 December 1999, as the day on which an indicative referendum is to be held under the Citizens Initiated Referenda Act 1993 on the following question:

Should there be a reform of our justice system placing greater emphasis on the needs of victims, providing restitution and compensation for them and imposing minimum sentences and hard labour for all serious violent offences?

The intention is that the referendum be held in 1999 on the polling day for the general election.

Saturday, 18 December 1999, is the last possible polling day for the general election.

If the writ for the general election appoints a polling day earlier than 18 December 1999, this order may be revoked and the earlier polling day may be appointed as the day for the holding of the referendum.

Notwithstanding this order or any other order made under section 22 of the Citizens Initiated Referenda Act 1993, the House of Representatives may, under section 22 (4) (b) (ii) of that Act, pass a resolution requiring the indicative referendum to be held on the polling day for the general election.

The referendum results from a petition promoted by Mr Norm Withers (which petition was presented to the House of Representatives on 13 July 1999 after it had been certified correct by the Clerk of the House of Representatives).
