I, Leanne Schmidt, hereby give notice that I intend to apply to the District Registrar of Companies at Christchurch, for the removal of the above-named company, having its registered office at care of 4 Thirlmere Road, Westmorland, Christchurch, on the grounds specified under section 318 (2) of the Companies Act 1993.

Unless written objections are lodged with the Registrar within 20 working days of the date of this notice, the company will be removed from the Register.

Advertisement of Application for Order

Under Section 174 of the Companies Act 1993

Take notice that on the 9th day of October 1998, an application for an order under section 174 of the Companies Act 1993, in respect of Gopher Directional Boring Systems Limited and Murray Durie Ferguson was filed in the High Court at Auckland.

The orders sought are orders:

A. Against the defendant company:

(i) That the defendant company be put into liquidation.

B. Against the second defendant:

(i) An inquiry as to the loss suffered by the plaintiff as a result of the actions of the second defendant;

(ii) An order that the second defendant acquire the plaintiff’s shares in the defendant company;

(iii) An order that the second defendant pay compensation for the full amount of loss suffered by the plaintiff as a result of the second defendant’s management of the affairs of the defendant company; and

(iv) Costs.

The application is to be heard before the High Court at Auckland on the 11th day of February 1999 at 10.00 a.m.

Any person, other than the defendant company, or Murray Durie Ferguson, who wishes to appear on the hearing of the application must file an appearance not later than the second working day before that day.
