Notice of Vacancy in Seat in House of Representatives

Pursuant to section 134 (1) of the Electoral Act 1993, I, Douglas Lorimer Kidd, Speaker of the House of Representatives, hereby give notice that Paul East has resigned his seat in the House of Representatives with effect from midnight on Monday, 25 January 1999, and that the said seat is vacant by reason of that resignation.

Warrant to Supply Vacancy

To the Chief Electoral Officer

Pursuant to the Electoral Act 1993, I hereby authorise and direct you to proceed forthwith to supply a member of Parliament to fill a vacancy created by the resignation of Paul East.

Declaration by Chief Electoral Officer That Alec Neill be Elected a Member of Parliament

On Tuesday 26 January 1999 I received a warrant from the Speaker of the House of Representatives to supply a member of Parliament to fill a vacancy created by the resignation of Paul East.

Pursuant to section 137 (2) of the Electoral Act 1993 I have determined that Alec Neill was the next unelected candidate whose name was included in the same party list as the member whose seat has been declared vacant and that it was Alec Neill’s name which stood highest in the order of preference.

Pursuant to section 137 (3) of the Electoral Act 1993 I have inquired of the Secretary of the political party on whose list Alec Neill’s name appeared whether he remains a member of that party and I have been informed by the Secretary of that political party that Alec Neill remains a member of that party.

Pursuant to section 137 (4) of the Electoral Act 1993 I have inquired of Alec Neill whether he is willing to be a member of Parliament and he has indicated his willingness to be a member of Parliament.

Therefore, I, Philip Raymond Whelan, Chief Electoral Officer, declare that Alec Neill is elected as a member of Parliament.
