Declaring Stopped Road in Timaru District Council to be Added to Endowment
Pursuant to section 117 (7) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Chief Crown Property Officer, Wellington, declares that, the stopped road described in the First Schedule hereto, shall be added to the land described in the Second Schedule held by Timaru District Council in trust as an endowment in aid of councils funds.

All that piece of land containing 718 square metres, being Section 926, Town of Arowhenua, comprised in certificate of title 22F/484, being stopped road, pursuant to Gazette notice 316754/1.

Easement Acquired for Communication for Police and Public Safety Purposes—Manawahe, Whakatane District
Pursuant to section 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Stephen Robert Gilbert, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, a right of way easement in gross (in common with the owner and any other lawful users) for a fixed term of 21 years from the 1st day of April 1997 (called “the commencement date”) for an annual rental of $1,600.00 plus G.S.T. per annum payable 6 monthly in advance, is acquired over the land owned by Mark James Charles Riddell and Shana-Kim Riddell (called “the owner”) described in the First Schedule to this notice and is vested in the Crown (called “the Crown”) for communication for police and public safety purposes.

The Crown shall keep the owner indemnified against all claims expenses and costs relating to loss or damage to stock or property arising out of the use of the right of way granted herein.

The Crown shall be entitled to enter into a maintenance agreement with any other authorised user of the right of way however notwithstanding any such agreement the Crown agrees as between the owner and the Crown to ensure that the right of way is maintained to a good quality 4-wheel drive standard at the Crown’s expense. In addition the Crown may at the Crown’s option either alone or in conjunction with other authorised users maintain the right of way to a higher standard. It is specifically agreed that the owner shall have no liability for the maintenance of the right of way in the absence of written agreement to that effect from time to time.

The Crown shall close all gates opened for the purpose of access and when using or maintaining the right of way take all reasonable steps to minimise the disturbance of stock on the owner’s land.
