Land Acquired for Road at Belgrove

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Kerry John Twydle, Land Information New Zealand, declares that, agreements to that effect having been entered into, the land described in the Schedule is acquired for road, which pursuant to section 60 (2) of the Transit New Zealand Act 1989, shall form part of State Highway No. 6 and shall vest in the Crown on the date of publication in the New Zealand Gazette.

Road Realignment at Takaka Hill

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, Kerry John Twydle, Land Information New Zealand:

(a) Pursuant to section 20, declares that, agreements to that effect having been entered into, the land described in the First Schedule is acquired for road, which pursuant to section 60 (2) of the Transit New Zealand Act 1989, shall form part of State Highway No. 60 and shall vest in the Crown on the date of publication in the New Zealand Gazette.

(b) Pursuant to sections 116, 117 and 120 (3), declares the road described in the Second Schedule to be stopped and further declares that;

(i) The area firstly described shall be amalgamated with the land in certificate of title 6D/268, subject to grant of right to convey water contained in transfer 351563.1 (Nelson Registry).

(ii) the area secondly described shall be amalgamated with the land in certificate of title 2B/259 (Nelson Registry).

Easement in Gross Acquired for Soil Conservation and River Control Purposes, Fernhill, Hastings District

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, Kerry John Twydle, Land Information New Zealand, declares that, an agreement having been entered into, the following easement in gross is acquired for soil conservation and river control purposes (and may be surrendered at any time by notice in the Gazette), vesting in The Hawke’s Bay Regional Council (called “the grantee”), the use of a right of way that shall be restricted to the provision of access for soil conservation and river control purposes and:

(a) to maintain or reconstruct the accessway as is necessary;

(b) the cost of forming and maintaining the right of way shall be borne in all things by the grantee except where damage to the right of way has been caused by the wilful act or negligence of the owner in which case the owner will be responsible to repair such damage;

(c) that heavy vehicles (as defined in the Transport Act 1962) may only pass over the said land between the hours of 7.00 a.m. and 6.00 p.m. Monday to Friday;

(d) the vehicles passing over the said land will not exceed a speed limit of 15 kph and to give effect to this condition the council shall erect a speed limit sign in the vicinity of the intersection of that area marked “A” on S.O. Plan 7399 and State Highway 50.

Except as modified herein the rights and powers set out in the Seventh Schedule to the Land Transfer Act 1952, shall be implied on the foregoing easement.
