Dumping and Countervailing Duties Act 1988

Cessation of Anti-Dumping Duties: Notice That Anti-Dumping Duties on Lead Acid Batteries From Indonesia, Korea, Malaysia, Singapore and Taiwan are to Cease to Apply

Subject to section 14 (9) of the Dumping and Countervailing Duties Act 1988 ("the Act"), anti-dumping duties on lead acid batteries from Indonesia, Korea, Malaysia, Singapore and Taiwan* will cease to apply to those goods on 21 June 1999 unless, at that date, the goods are subject to review under section 14 (8) of the Act.

Any interested party that might request the Secretary of Commerce to initiate a review before the termination date referred to above, should be aware that positive evidence justifying the need for a review must be provided to the Secretary.

If an application is received which provides positive evidence justifying the need for a review, the Secretary must undertake a review investigation and report to the Minister of Commerce within 180 days on whether the anti-dumping duties should continue to be applied. Positive evidence justifying the need for a review would need to provide reasons for believing that the expiration of anti-dumping duties would see the continuation or recurrence of dumping of lead acid batteries from Indonesia, Korea, Malaysia, Singapore and Taiwan, and for believing that such dumping would be likely to cause the continuation or recurrence of material injury to the New Zealand industry producing lead acid batteries. The reasons should be supported by evidence and not based on mere allegations or assertions.

Notice of Initiation of New Shipper Duty Reassessment for Lead Acid Batteries From Malaysia

Pursuant to section 14 (6) of the Dumping and Countervailing Duties Act 1988 ("the Act"), and under delegated authority from the Secretary of Commerce, I hereby give notice that I have initiated a reassessment of the amount of anti-dumping duty in respect of imports into New Zealand of the goods described in the Schedule.

Schedule

Goods Subject to Investigation

Lead acid automotive replacement batteries for the passenger motor vehicle market and marine applications (excluding DIN batteries and deep cycle marine batteries) when manufactured by GP Autobat Sdn Bhd.

Country of Origin

Malaysia.

Description of Goods

The goods are currently classified under Tariff Items and Statistical Keys 8507.10.09.12J, 8507.10.09.15C, and 8507.10.09.19F of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.
