Exemptions From the Requirement for Animal Welfare Export Certificates Under the Animal Welfare Act 1999 Notice No. 1145

Having had regard to the matters set out in section 48 (3) of the Animal Welfare Act 1999 and being satisfied that the risk to the welfare of the animals specified in this notice is minimal, I hereby give notice that:

Pursuant to sections 40 (2) (a) and section 48 (1) the following animals are exempt from the requirements of section 40 (1):

crayfish
crab
fish
lobster
pet animals departing on any ship.

And, that the following animals are exempt from the requirements of section 40 (1) on the condition that the animals are exported to a destination being less than 6 hours travel time from the point of departure in New Zealand:

birds not subject to the Wildlife Act 1953 or the Trade in Endangered Species Act 1989
camelids
cats
cattle
deer
dogs
ferrets
goats
guinea pigs
hamsters
hares
hedgehogs
horses
octopus
pigs
possums
rabbits
ratites
rodents
sheep

wallabies

Dumping and Countervailing Duties Act 1988

Notice of Inquiry Regarding the Continued Existence of a Sweetened Condensed Milk Industry in New Zealand

Having been advised that Nestlé New Zealand Limited has ceased its production of sweetened condensed milk in retail sized cans in New Zealand, the Ministry of Commerce is undertaking an inquiry as to whether or not there continues to be a New Zealand industry producing these goods.

Anti-dumping duties were imposed on sweetened condensed milk from Thailand in April 1995 as a result of an investigation into claims made by Nestlé that these goods were being dumped and were thereby causing material injury to the New Zealand industry.

Should it be found that there is no longer a New Zealand industry, a recommendation will be made to the Minister for Enterprise and Commerce that he terminate the anti-dumping duties.

If a New Zealand industry is found to still exist, it may be necessary to carry out a formal review of the continued need for the imposition of anti-dumping duties on the goods concerned.
