Thomas Stubberfield, late of Christchurch, retired company manager, deceased, has filed in the office of the High Court at Christchurch, an application for approval of a scheme varying the terms of the will under which the H T Stubberfield Trust Fund (being the deceased’s residuary estate) is held. Under the will, the H T Stubberfield Trust Fund is to be held on perpetual trusts to pay the income for such charitable purpose or purposes in New Zealand as the president of the Rotary Club of Christchurch for the time being shall decide.
Under this scheme, the trustees will have the following powers or discretions:

For the purposes of calculating the income arising from any investment, the trustees may in their discretion deem the whole or any part of the increase in the capital value of any investment in a managed fund, unit trust, insurance bond or other capital fund in any year as income and available for distribution as income provided that the trustees shall not be bound to exercise such discretion at all or at any time or times and shall not be liable to any beneficiary in respect of any decision made by the trustees and exercise of such power or their omission to do so.

The trustees shall not be bound to pay or apply the whole or any part of the net annual income in any year or any years and may retain and invest a portion as a reserve fund. The trustees may at any subsequent time or times pay or apply the whole or any part of the reserve fund for the Trust’s charitable purposes.
Copies of the scheme and the report of the Attorney-General thereon may be inspected, free of charge, at the office of the Registrar of the High Court at Christchurch or at the offices of Lane Neave Ronaldson, Barristers and Solicitors, Level Fifteen, 119 Armagh Street, Christchurch, the solicitors for the trustees.
The application has been set down for hearing in the High Court at Christchurch on Tuesday, 7 December 1999 at 9.00 a.m.
Any person desiring to oppose the scheme is required to give notice of his or her intention to do so to the Registrar of the High Court at Christchurch and to D. A. Inder, solicitor for the trustees, at the offices of Lane Neave Ronaldson, Christchurch, and to the Attorney-General at the offices of the Crown Law Office in Wellington, not less than seven (7) clear days before the above-mentioned date.

Notice of Application for Approval of a Scheme Under Part III of the Charitable Trusts Act 1957
Pursuant to the Charitable Trusts Act 1957
Notice is hereby given that Lady Isaac, Allan William Jones and Robert Geoffrey McGregor Clarke, as trustees of the Isaac Wildlife Trust, have filed in the office of the High Court at Christchurch, an application for approval of a scheme varying the terms of the Isaac Wildlife Trust (‘the trust’).
Under the current provisions of the trust, the purpose of the trust is the preservation and conservation of wildlife and Lady Isaac has a central role as trustee of the trust.
Under the scheme, the purpose of the trust will be expanded so as to include the conservation of buildings of historic and aesthetic significance and the contents of those buildings vested in the trust.
Under the scheme, the future mode of administration of the trust will be varied to establish appropriate provisions to apply upon the retirement of Lady Isaac as trustee, including more detailed provisions as to the future appointment of trustees, the conduct of meetings and the exercise of the trustees’ powers.
Copies of the scheme and the report of the Attorney-General approving the scheme may be inspected free of charge, at the office of the Registrar of the High Court at Christchurch or at the offices of Lane Neave Ronaldson, solicitors for the trustees, Level Fifteen, 119 Armagh Street, Christchurch.
