This note prescribes that, pursuant to regulation 13 of the Radiocommunications (Radio) Regulations 1993, a general licence is granted in respect of the installation, operation and use of spread spectrum radio apparatus on the frequencies specified in this notice. This notice comes into effect on 4 February 1999.

(General Licence for Radio Buoy Apparatus)
Notice 1999

Pursuant to regulation 13 of the Radiocommunications (Radio) Regulations 1993, and acting under delegated authority from the Secretary of Commerce, I give the following notice.

N o t i c e

  1. Short title and commencement—(1) This notice may be cited as the Radiocommunications (Radio) Regulations (General Licence for Radio Buoy Apparatus) Notice 1999.

(2) This notice comes into force on 4 February 1999.

  1. General licence—A licence under regulation 13 of the Radiocommunications (Radio) Regulations 1993 is granted in respect of the installation, operation, and use, by persons within the territorial waters of New Zealand, of radio apparatus for the purpose of indicating and locating the position of nets, long-lines, crayfish pots and other materials used in the process of fishing.

  2. Terms, conditions and restrictions—(1) This licence applies only to radio apparatus for which a declaration of conformity has been submitted to the Secretary under regulation 43 of the Radiocommunications (Radio) Regulations 1993.

(2) The transmitter carrier frequencies available for use under this licence are those specified in the First Schedule to this notice.

(3) The technical conditions applying under this licence are those specified in the Second Schedule to this notice.

(4) Frequency use is on a shared basis and the Secretary does not accept any liability under any circumstances for any loss or damage of any kind occasioned by the unavailability of frequencies or interference to reception.

(5) Should interference occur the Secretary reserves the right to require that any radio apparatus licenced herein change frequency or cease operation.

  1. Period of validity of licence—This licence expires on 31 January 2004.

  1. Short title and commencement—(1) This notice may be cited as the Radiocommunications (Radio) Regulations (General Licence for 406 MHz Emergency Position Indicating Radio Beacons) Notice 1999.

(2) This notice comes into force on 4 February 1999.

  1. General licence—A licence under regulation 13 of the Radiocommunications (Radio) Regulations 1993 is granted for the installation, operation, and use of emergency position indicating radio beacons on any New Zealand ship and any aircraft registered in New Zealand for the transmission of radio distress alerts for the purpose of determining both the location and identity of persons, vessels, or aircraft in distress in conjunction with the COSPAS-SARSAT system.

  2. Terms, conditions and restrictions—(1) This licence applies only to apparatus which complies with
