Explanatory Note
This note is not part of the notice, but is intended to indicate its general effect.
This note prescribes that, pursuant to regulation 13 of the Radiocommunications (Radio) Regulations 1993, a general licence is granted in respect of the installation, operation and use of radio apparatus on frequencies specified in this notice. The previous general licence in respect of the frequencies specified is revoked. The licence applies only to radio apparatus which complies with technical specification RFS23 (Issue 3, December 1988) and in respect of which a certificate of compliance has been issued by the Secretary under regulation 37 of the Radio Regulations 1987 or a declaration of conformity has been submitted to the Secretary under regulation 43 of the Radiocommunications (Radio) Regulations 1993. This notice comes into effect on 4 February 1999.

(General Licence for Restricted Radiation Radio Apparatus) Notice 1999
Pursuant to regulation 13 of the Radiocommunications (Radio) Regulations 1993, and acting under delegated authority from the Secretary of Commerce, I give the following notice:

1. Short title and commencement—(1) This notice may be cited as the Radiocommunications (Radio) Regulations (General Licence for Restricted Radiation Radio Apparatus) Notice 1999.
(2) This notice comes into force on 4 February 1999.
2. General licence—A general licence under regulation 13 of the Radiocommunications (Radio) Regulations 1993 is granted for the installation, operation, and use of radio apparatus in accordance with the terms of this notice.
2. Terms, conditions and restrictions—(1) This licence applies only to apparatus which complies with technical specification RFS 29 (Issue 8, February 1998) and in respect of which a declaration of conformity has been submitted to the Secretary under regulation 43 of the Radiocommunications (Radio) Regulations 1993.
(2) The frequencies available for use under this licence are those specified in the First Schedule to this notice.
(3) The maximum powers for transmission for available frequencies are those specified in the First Schedule to this notice.
(4) The specific uses allowable for available frequencies are those specified in the First Schedule to this notice.
(5) The technical conditions applying under this licence are those specified in the Second Schedule to this notice.
(6) Frequency use is on a shared basis and the Secretary does not accept liability under any circumstances for any loss or damage of any kind occasioned by the unavailability of frequencies or interference to reception.
(6) Should interference occur the Secretary reserves the right to require that any apparatus licensed herein change frequency or cease operation.
4. Period of validity of licence—This licence expires on 31 January 2004.
