Application for Orders Under Part III of the Charitable Trusts Act 1957 to Vary the Terms of The Frederick Seymour Potter Trust Deed Dated the 11th Day of January 1929 (The Potter Trust)

An application will be made on behalf of the trustees of The Potter Trust to the High Court at Auckland on the 15th day of November 1999 for orders varying the terms of The Potter Trust as follows:

1. The leasehold land owned by the trustees of The Potter Trust at 337–353 Ellerslie Panmure Highway, 19, 21 and 27 Ferndale Road, Mount Wellington and 1–15 Faber Avenue, Mount Wellington, be transferred to the trustees of a new trust to be formed and to be known as The Frederick Seymour Potter Masonic Trust (the new trust).

2. The powers of the trustees under the new trust be extended or varied from those contained in The Potter Trust to include a power to sell all or any of the trust property.

3. The District Land Registrar at Auckland remove caveat X16493 currently lodged against the freehold.
