This certifies that the vessel M.V. is operating under the direct authority of the joint organisers of the America’s Cup Regatta and accordingly, is exempted from the provisions of the Submarine Cables and Pipelines Protection Order 1992 to the extent that the vessel is permitted to anchor in Protected Area 2 — Hauraki Gulf, for the duration of the America’s Cup Regatta.

Liability for Damage

Notwithstanding the fact that a ship has been exempted it is an offence under section 11 of the Submarine Cables and Pipelines Protection Act 1996 to damage a submarine cable or submarine pipeline wilfully or negligently.

Notice of Appointment of Protection Officers

Whereas, pursuant to section 441 of the Maritime Transport Act 1994, the Minister of Transport did delegate those powers under section 16 (1) of the Submarine Cables and Pipelines Protection Act 1996 to the Maritime Safety Authority by an Instrument of Delegation dated 19 March 1997.

And whereas, pursuant to section 442 of the Maritime Transport Act 1994, the Maritime Safety Authority did delegate those powers under section 16 (1) of the Submarine Cables and Pipelines Protection Act 1996 to me by an Instrument of Delegation dated 26 March 1997.

Water Recreation Regulations 1979

The Water Recreation (Upper Clutha River) Notice 1999

I, John Norman Keith Mansell, Divisional Manager, Maritime Operations, pursuant to regulations 10 and 20 of the Water Recreation Regulations 1979*, and in exercise of powers delegated to me, pursuant to section 257A of the Harbours Act 1950 and section 443 of the Maritime Transport Act 1994, hereby give the following notice:

Notice

  1. (a) This notice may be cited as the Water Recreation (Upper Clutha River) Notice 1999.

(b) This notice shall come into force 14 days after publication in the New Zealand Gazette and shall remain in force until revoked by further notice in the New Zealand Gazette.

  1. Subject to the conditions set forth in the Second Schedule hereto, regulations 7 (1) (a), 7 (1) (b) and 7 (2) of the Water Recreation Regulations 1979, shall not apply to the area specified in the First Schedule.

First Schedule

The Upper Clutha River from the upper boundary of the Bendigo Wildlife Park (45° 54.5′ S, 169° 18.8′ E) to the border of the Queenstown Lakes District Council and Central Otago District Council at Sandy Point (44° 45′ S, 169° 19.8′ E).

Second Schedule

  1. Notwithstanding any other provision of this notice, no person who is permitted by any such provision to propel or navigate a small craft at a speed exceeding 5 knots shall do so in any manner that is likely to endanger or unduly annoy any person who is in, on, or using the waters or fishing, or undertaking any recreational activity in the vicinity of the small craft.

  2. All person in charge of a vessel shall adhere to and keep the provisions of all Acts and regulations not specifically exempted by this notice.
