declares an agreement to that effect having been entered into, the right of way easement hereinafter described as acquired as an easement in gross over the land described in the Schedule for soil conservation and river control purposes (and may be surrendered at any time by notice in the New Zealand Gazette and shall vest in The Hawke’s Bay Regional Council (called “the grantee”) on the date of publication hereof in the New Zealand Gazette.

Right of Way

(a) Except as modified herein the rights and powers set out in the Seventh Schedule of the Land Transfer Act 1952, shall be implied in this easement.

(b) The use of the right of way shall be restricted to the provision of access for undertaking soil conservation and river control purposes.

(c) The grantee may maintain or reconstruct the right of way as necessary.

(d) The cost of forming (if required) and maintaining the right of way shall be borne in all things by the grantee.

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Regional Crown Property Services, Land Information New Zealand, Auckland, declares that, an agreement to that effect having been entered into, the land firstly described in the Schedule, is acquired for road and the land secondly described in the Schedule, is acquired for local purposes reserve (pump station site) and the said pieces of land shall vest in The Manukau City Council on the date of publication in the New Zealand Gazette.
