Fisheries Act 1983

Fisheries (Quota Aggregation Limit Exemption) Notice (No. 1) 1998 (No. F79)

Pursuant to section 28W (3) of the Fisheries Act 1983, the Minister of Fisheries, after consultation with the New Zealand Fishing Industry Board and the Treaty of Waitangi Fisheries Commission, and after having regard to the provisions of section 28W (5) of the Fisheries Act 1983, hereby gives the following notice.

  1. Title and commencement—(1) This notice may be cited as the Fisheries (Quota Aggregation Limit Exemption) Notice (No. 1) 1998.

(2) This notice shall come into effect on the day after its notification in the New Zealand Gazette.

  1. Interpretation—In this notice, “Cook Strait Group” means Fastforward Holdings Limited, any related company as defined in section 2 (3) of the Companies Act 1993 or any person or company associated with Fastforward Holdings Limited for the purposes of the relevant fisheries legislation.

  2. Exemption to quota aggregation limit—As from the date this notice comes into effect, the Cook Strait Group is permitted to hold quota and interest in quota in excess of the 10 percent aggregation limit as provided in section 28W (1) (b) of the Fisheries Act 1983 for spiny rock lobster in quota management area 6, up to an aggregation limit of 15.57 percent.
